鉴于乙方现在属于兼职用工人员，乙方不具备劳动法律关系的主体资格，无法与甲方建立劳动（合同）关系。

甲乙双方经平等协商，共同决定建立劳务关系。

因此，本计月服务协议属于劳务协议，不在《中华人民共和国劳动法》调整范围内，而在《中华人民共和国民法通则》的调整之中。

甲乙双方在充分明确这一法律关系的基础上，根据《民法通则》和其他相关法律、法规，自愿签订本协议，共同遵守协议所列条款。

一、协议期限

本协议期限自年月日起，至年月日止，其中前90天为试工期（注：

本试工期与劳动法中的试用期不是同一概念）。

试工期内，甲乙双方均可无条件随时通知对方解除本协议。

二、工作条件

甲方应根据国家有关规定，为乙方提供符合职业安全卫生条件的工作环境。

三、工作（生产）任务

乙方同意服从甲方的工作（生产）需要，在岗位，承担工作（生产）任务。

四、工作要求

1.乙方的工作岗位由甲方根据工作需要进行安排和调整。

乙方必须按照甲方的工作要求，尽职尽责做好工作。

2.乙方应严格遵守国家各项法律规定。

遵守甲方的工作规范、操作规程、劳动安全卫生制度等各项规章制度，包括《员工手册》中写明的各项规定和要求。

3.爱护甲方财物，保守甲方机密，维护甲方利益,服从甲方的领导、管理和教育。

4.对于因乙方过失给甲方造成经济损失的，甲方有权要求乙方承担赔偿责任。

五、劳动报酬

甲乙双方约定，乙方的工资为元/月，在履行本协议期间如有薪资调整或变化，则调整后按新标准执行。

乙方作为劳务人员，在甲方工作期间，只享受本协议中约定的福利和待遇，甲方内部文件中涉及的员工其他福利或待遇均不适用于乙方。

六、协议的解除与终止

1．在本协议期限内，任何一方均有权提前十五个工作日通知对方解除本协议。

解除本协议不需支付经济补偿金。

2．甲方因乙方违纪，可随时与乙方解除本协议。

此时，不需按上款规定提前通知乙方。

3．甲方不按本协议约定提供必要的劳动条件或劳动报酬时，乙方可以随时解除本协议，不受提前通知的限制。

4．本协议到期或过期，如双方未续签，自行终止本协议，不需提前通知。

5．甲乙双方无论因何原因解除或终止本协议，乙方均应立即办理工作交接、归还甲方财、物等离职手续。

具体程序如下：

乙方离职时应按规定交接相关的工作，直到离职手续完成为止，公司才发放当月工资,如离职时没有完成归还甲方财、物等离职手续而离开，甲方有权在不违反公布及可公开获悉的法律、法规的原则下，扣除乙方的部分工资、其他报酬及报销费用，以抵充乙方欠负甲方的任何数额及/或以支付法律、法规规定的其他税项、费用等及/或以作为其他合法用途。

七、其他

1．乙方的人事档案仍由原单位管理，甲方不负责处理与乙方人事档案有关的任何事宜。

2．因甲乙双方之间建立的关系是劳务关系而不是劳动（合同）关系，因此甲方不承担任何社会保险缴纳义务。

3．双方如因履行协议发生争议，应首先友好协商解决。

协商不成，任何一方都有权向甲方所在地人民法院提起诉讼。

4．本协议一式两份，甲乙双方各执一份，自签订之日起生效。
