A1.1.3

Anexceptiontostrictcompliancewiththenightworkrestrictionmaybe　madebythecompetentauthoritywhen:

（a）theeffectivetrainingoftheseafarersconcerned,inaccordancewithestablishedprogrammesandschedules,wouldbeimpaired;or

（b）thespecificnatureofthedutyorarecognizedtrainingprogrammerequiresthattheseafarerscoveredbytheexceptionperformdutiesatnightandtheauthoritydetermines,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,thattheworkwillnotbedetrimentaltotheirhealthorwell-being.

A1.1.4

Theemployment,engagementorworkofseafarersundertheageof18shallbeprohibitedwheretheworkislikelytojeopardizetheirhealthorsafety.Thetypesofsuchworkshallbedeterminedbynationallawsorregulationsorbythecompetentauthority,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,inaccordancewithrelevantinternationalstandards.

A1.2.1

Thecompetentauthorityshallrequirethat,priortobeginningworkonaship,seafarersholdavalidmedicalcertificateattestingthattheyaremedicallyfittoperformthedutiestheyaretocarryoutatsea.

A1.2.2

Inordertoensurethatmedicalcertificatesgenuinelyreflectseafarers’stateofhealth,inlightofthedutiestheyaretoperform,thecompetentauthorityshall,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,andgivingdueconsiderationtoapplicableinternationalguidelinesreferredtoinPartBofthisCode,prescribethenatureofthemedicalexaminationandcertificate.

A1.2.3

ThisStandardiswithoutprejudicetotheInternationalConventiononStandardsofTraining,CertificationandWatchkeepingforSeafarers,1978,asamended（“STCW”）.AmedicalcertificateissuedinaccordancewiththerequirementsofSTCWshallbeacceptedbythecompetentauthority,forthepurposeofRegulation1.2.Amedicalcertificatemeetingthesubstanceofthoserequirements,inthecaseofseafarersnotcoveredbySTCW,shallsimilarlybeaccepted.

A1.2.4

Themedicalcertificateshallbeissuedbyadulyqualifiedmedicalpractitioneror,inthecaseofacertificatesolelyconcerningeyesight,byapersonrecognizedbythecompetentauthorityasqualifiedtoissuesuchacertificate.Practitionersmustenjoyfullprofessionalindependenceinexercisingtheirmedicaljudgementinundertakingmedicalexaminationprocedures.

A1.2.5

Seafarersthathavebeenrefusedacertificateorhavehadalimitationimposedontheirabilitytowork,inparticularwithrespecttotime,fieldofworkortradingarea,shallbegiventheopportunitytohaveafurtherexaminationbyanotherindependentmedicalpractitionerorbyanindependentmedicalreferee.

A1.2.6

Eachmedicalcertificateshallstateinparticularthat:

（a）thehearingandsightoftheseafarerconcerned,andthecolourvisioninthecaseofaseafarertobeemployedincapacitieswherefitnessfortheworktobeperformedisliabletobeaffectedbydefectivecolourvision,areallsatisfactory;and

（b）theseafarerconcernedisnotsufferingfromanymedicalconditionlikelytobeaggravatedbyserviceatseaortorendertheseafarerunfitforsuchserviceortoendangerthehealthofotherpersonsonboard.

A1.2.7

UnlessashorterperiodisrequiredbyreasonofthespecificdutiestobeperformedbytheseafarerconcernedorisrequiredunderSTCW:

（a）amedicalcertificateshallbevalidforamaximumperiodoftwoyearsunlesstheseafarerisundertheageof18,inwhichcasethemaximumperiodofvalidityshallbeoneyear;

（b）acertificationofcolourvisionshallbevalidforamaximumperiodofsixyears.

A1.2.8

Inurgentcasesthecompetentauthoritymaypermitaseafarertoworkwithoutavalidmedicalcertificateuntilthenextportofcallwheretheseafarercanobtain

amedicalcertificatefromaqualifiedmedicalpractitioner,providedthat:

（a）theperiodofsuchpermissiondoesnotexceedthreemonths;and

（b）theseafarerconcernedisinpossessionofanexpiredmedicalcertificateofrecentdate.

A1.2.9

Iftheperiodofvalidityofacertificateexpiresinthecourseofavoyage,thecertificateshallcontinueinforceuntilthenextportofcallwheretheseafarercanobtainamedicalcertificatefromaqualifiedmedicalpractitioner,providedthattheperiodshallnotexceedthreemonths.

A1.2.10

ThemedicalcertificatesforseafersworkingonshipsordinarilyengagedoninternationalvoyagesmustasaminimumbeprovidedinEnglish.

Seafarersshallnotbepermittedtoworkonashipunlesstheyhavesuccessfullycompletedtrainingforpersonalsafetyonboardship.

R1.3.3

TrainingandcertificationinaccordancewiththemandatoryinstrumentsadoptedbytheInternationalMaritimeOrganizationshallbeconsideredasmeetingtherequirementsofparagraphs1and2ofthisRegulation.

R1.3.4

AnyMemberwhich,atthetimeofitsratificationofthisConvention,wasboundbytheCertificationofAbleSeamenConvention,1946（No.74）,shallcontinuetocarryouttheobligationsunderthatConventionunlessanduntilmandatoryprovisionscoveringitssubjectmatterhavebeenadoptedbytheInternationalMaritimeOrganizationandenteredintoforce,oruntilfiveyearshaveelapsedsincetheentryintoforceofthisConventioninaccordancewithparagraph3ofArticleVIII,whicheverdateisearlier.

R1.4.1

Allseafarersshallhaveaccesstoanefficient,adequateandaccountablesystemforfindingemploymentonboardshipwithoutchargetotheseafarer.

R1.4.2

SeafarerrecruitmentandplacementservicesoperatinginaMember’sterritoryshallconformtothestandardssetoutintheCode.

R1.4.3

EachMembershallrequire,inrespectofseafarerswhoworkonshipsthatflyitsflag,thatshipownerswhouseseafarerrecruitmentandplacementservicesthatare

basedincountriesorterritoriesinwhichthisConventiondoesnotapply,ensurethatthoseservicesconformtotherequirementssetoutintheCode.StandardA1.4.Recruitmentandplacement

A1.4.1

EachMemberthatoperatesapublicseafarerrecruitmentandplacementserviceshallensurethattheserviceisoperatedinanorderlymannerthatprotectsandpromotesseafarers’employmentrightsasprovidedinthisConvention.

A1.4.2

WhereaMemberhasprivateseafarerrecruitmentandplacementservicesoperatinginitsterritorywhoseprimarypurposeistherecruitmentandplacementofseafarersorwhichrecruitandplaceasignificantnumberofseafarers,theyshallbeoperatedonlyinconformitywithastandardizedsystemoflicensingorcertificationorotherformofregulation.Thissystemshallbeestablished,modifiedorchangedonlyafterconsultationwiththeshipowners’andseafarers’organizationsconcerned.IntheeventofdoubtastowhetherthisConventionappliestoaprivaterecruitmentandplacementservice,thequestionshallbedeterminedbythecompetentauthorityineachMemberafterconsultationwiththeshipowners’andseafarers’organizationsconcerned.

Undueproliferationofprivateseafarerrecruitmentandplacementservicesshallnotbeencouraged.

A1.4.3

Theprovisionsofparagraph2ofthisStandardshallalsoapply.totheextentthattheyaredeterminedbythecompetentauthority,inconsultationwiththeshipowners’andseafarers’organizationsconcerned,tobeappropriate.inthecontextofrecruitmentandplacementservicesoperatedbyaseafarers’organizationintheterritoryoftheMemberforthesupplyofseafarerswhoarenationalsofthatMembertoshipswhichflyitsflag.Theservicescoveredbythisparagrapharethosefulfillingthefollowingconditions:

（a）therecruitmentandplacementserviceisoperatedpursuanttoacollectivebargainingagreementbetweenthatorganizationandashipowner;（b）b
