Anexceptiontostrictcompliancewiththenightworkrestrictionmaybe madebythecompetentauthoritywhen:
(a)theeffectivetrainingoftheseafarersconcerned,inaccordancewithestablishedprogrammesandschedules,wouldbeimpaired;or
(b)thespecificnatureofthedutyorarecognizedtrainingprogrammerequiresthattheseafarerscoveredbytheexceptionperformdutiesatnightandtheauthoritydetermines,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,thattheworkwillnotbedetrimentaltotheirhealthorwell-being.
A1.1.4
Theemployment,engagementorworkofseafarersundertheageof18shallbeprohibitedwheretheworkislikelytojeopardizetheirhealthorsafety.Thetypesofsuchworkshallbedeterminedbynationallawsorregulationsorbythecompetentauthority,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,inaccordancewithrelevantinternationalstandards.

A1.2.1
Thecompetentauthorityshallrequirethat,priortobeginningworkonaship,seafarersholdavalidmedicalcertificateattestingthattheyaremedicallyfittoperformthedutiestheyaretocarryoutatsea.
A1.2.2
Inordertoensurethatmedicalcertificatesgenuinelyreflectseafarers’stateofhealth,inlightofthedutiestheyaretoperform,thecompetentauthorityshall,afterconsultationwiththeshipowners’andseafarers’organizationsconcerned,andgivingdueconsiderationtoapplicableinternationalguidelinesreferredtoinPartBofthisCode,prescribethenatureofthemedicalexaminationandcertificate.
A1.2.3
ThisStandardiswithoutprejudicetotheInternationalConventiononStandardsofTraining,CertificationandWatchkeepingforSeafarers,1978,asamended(“STCW”).AmedicalcertificateissuedinaccordancewiththerequirementsofSTCWshallbeacceptedbythecompetentauthority,forthepurposeofRegulation1.2.Amedicalcertificatemeetingthesubstanceofthoserequirements,inthecaseofseafarersnotcoveredbySTCW,shallsimilarlybeaccepted.
A1.2.4
Themedicalcertificateshallbeissuedbyadulyqualifiedmedicalpractitioneror,inthecaseofacertificatesolelyconcerningeyesight,byapersonrecognizedbythecompetentauthorityasqualifiedtoissuesuchacertificate.Practitionersmustenjoyfullprofessionalindependenceinexercisingtheirmedicaljudgementinundertakingmedicalexaminationprocedures.
A1.2.5
Seafarersthathavebeenrefusedacertificateorhavehadalimitationimposedontheirabilitytowork,inparticularwithrespecttotime,fieldofworkortradingarea,shallbegiventheopportunitytohaveafurtherexaminationbyanotherindependentmedicalpractitionerorbyanindependentmedicalreferee.
A1.2.6
Eachmedicalcertificateshallstateinparticularthat:
(a)thehearingandsightoftheseafarerconcerned,andthecolourvisioninthecaseofaseafarertobeemployedincapacitieswherefitnessfortheworktobeperformedisliabletobeaffectedbydefectivecolourvision,areallsatisfactory;and
(b)theseafarerconcernedisnotsufferingfromanymedicalconditionlikelytobeaggravatedbyserviceatseaortorendertheseafarerunfitforsuchserviceortoendangerthehealthofotherpersonsonboard.
A1.2.7
UnlessashorterperiodisrequiredbyreasonofthespecificdutiestobeperformedbytheseafarerconcernedorisrequiredunderSTCW:
(a)amedicalcertificateshallbevalidforamaximumperiodoftwoyearsunlesstheseafarerisundertheageof18,inwhichcasethemaximumperiodofvalidityshallbeoneyear;
(b)acertificationofcolourvisionshallbevalidforamaximumperiodofsixyears.
A1.2.8
Inurgentcasesthecompetentauthoritymaypermitaseafarertoworkwithoutavalidmedicalcertificateuntilthenextportofcallwheretheseafarercanobtain
amedicalcertificatefromaqualifiedmedicalpractitioner,providedthat:
(a)theperiodofsuchpermissiondoesnotexceedthreemonths;and
(b)theseafarerconcernedisinpossessionofanexpiredmedicalcertificateofrecentdate.
A1.2.9
Iftheperiodofvalidityofacertificateexpiresinthecourseofavoyage,thecertificateshallcontinueinforceuntilthenextportofcallwheretheseafarercanobtainamedicalcertificatefromaqualifiedmedicalpractitioner,providedthattheperiodshallnotexceedthreemonths.
A1.2.10
ThemedicalcertificatesforseafersworkingonshipsordinarilyengagedoninternationalvoyagesmustasaminimumbeprovidedinEnglish.

TrainingandcertificationinaccordancewiththemandatoryinstrumentsadoptedbytheInternationalMaritimeOrganizationshallbeconsideredasmeetingtherequirementsofparagraphs1and2ofthisRegulation.
R1.3.4
AnyMemberwhich,atthetimeofitsratificationofthisConvention,wasboundbytheCertificationofAbleSeamenConvention,1946(No.74),shallcontinuetocarryouttheobligationsunderthatConventionunlessanduntilmandatoryprovisionscoveringitssubjectmatterhavebeenadoptedbytheInternationalMaritimeOrganizationandenteredintoforce,oruntilfiveyearshaveelapsedsincetheentryintoforceofthisConventioninaccordancewithparagraph3ofArticleVIII,whicheverdateisearlier.

Allseafarersshallhaveaccesstoanefficient,adequateandaccountablesystemforfindingemploymentonboardshipwithoutchargetotheseafarer.
R1.4.2
SeafarerrecruitmentandplacementservicesoperatinginaMember’sterritoryshallconformtothestandardssetoutintheCode.
R1.4.3
EachMembershallrequire,inrespectofseafarerswhoworkonshipsthatflyitsflag,thatshipownerswhouseseafarerrecruitmentandplacementservicesthatare
basedincountriesorterritoriesinwhichthisConventiondoesnotapply,ensurethatthoseservicesconformtotherequirementssetoutintheCode.StandardA1.4.Recruitmentandplacement
A1.4.1
EachMemberthatoperatesapublicseafarerrecruitmentandplacementserviceshallensurethattheserviceisoperatedinanorderlymannerthatprotectsandpromotesseafarers’employmentrightsasprovidedinthisConvention.
A1.4.2
WhereaMemberhasprivateseafarerrecruitmentandplacementservicesoperatinginitsterritorywhoseprimarypurposeistherecruitmentandplacementofseafarersorwhichrecruitandplaceasignificantnumberofseafarers,theyshallbeoperatedonlyinconformitywithastandardizedsystemoflicensingorcertificationorotherformofregulation.Thissystemshallbeestablished,modifiedorchangedonlyafterconsultationwiththeshipowners’andseafarers’organizationsconcerned.IntheeventofdoubtastowhetherthisConventionappliestoaprivaterecruitmentandplacementservice,thequestionshallbedeterminedbythecompetentauthorityineachMemberafterconsultationwiththeshipowners’andseafarers’organizationsconcerned.
Undueproliferationofprivateseafarerrecruitmentandplacementservicesshallnotbeencouraged.
A1.4.3
Theprovisionsofparagraph2ofthisStandardshallalsoapply.totheextentthattheyaredeterminedbythecompetentauthority,inconsultationwiththeshipowners’andseafarers’organizationsconcerned,tobeappropriate.inthecontextofrecruitmentandplacementservicesoperatedbyaseafarers’organizationintheterritoryoftheMemberforthesupplyofseafarerswhoarenationalsofthatMembertoshipswhichflyitsflag.Theservicescoveredbythisparagrapharethosefulfillingthefollowingconditions:
(a)therecruitmentandplacementserviceisoperatedpursuanttoacollectivebargainingagreementbetweenthatorganizationandashipowner;(b)b
