Instructions
Article1Beforesigningthiscontract,thetwopartiesshallreadthiscontractcarefully.Thiscontractoncesignedhaslegalvalidity,twopartiesmuststrictlyperform.
Article2Thiscontractmustbesignedorsealedbytheemployer'slegalrepresentativeortheprincipalresponsibleperson(PartyA)andtheemployee(PartyB),andaffixtheofficialsealoftheemployer(orthespecialsealofthelaborcontract).
Article3Theemptycolumninthiscontract,shouldbefilledinbytwopartiesthroughnegotiation,andshallnotviolatelaws,provisions,andrelevantregulations;emptycolumnnotneedtobefilledin,mark“/”.
Article4Workinghourssystemisdividedintostandardworkinghours,non-fixworkinghours,andcomprehensivecalculationworkinghours.Theirregularworkinghours,andcomprehensivecalculationworkinghours,shouldbeapprovedbylaboradministrationauthorities.
Article5Theunfinishedmattersofthiscontract,maysignasupplementaryagreement,astheattachmentofthiscontract,andbeperformedwiththecontracttogether.
Article6Thiscontractmustfillinseriously,writelegibly,textbeconciseandaccurate,andshallnotalterarbitrarily.

Article3WorkingHours,andRestandLeave
A.ThePartiesagreetodeterminethetermoftheworkinghourpursuanttomodebelow:
1.Standardworkinghourssystem.PartyBshallworkforhoursaday,andhoursaweek.PartyAshallguaranteethatPartyBhasatleastonedayoffinaweek.
2.Non-scheduleworkinghoursystem.ThepositionofPartyBpracticesnon-scheduleworkinghoursystemaftertheapprovalofthelaboradministrationauthority.
3.Systemofcomprehensivecalculationofworkinghour.ThepositionofPartyBpracticessystemofcomprehensivecalculationofworkinghouraftertheapprovalofthelaboradministrationauthority;calculationcircle;totalworkinghours.
B.PartyAmayextendworkinghoursduetotherequirementofitsproductionorbusinessafterconsultationwiththeTradeUnionandthePartyB,but,withtheexceptionofthecircumstancesstipulatedinArticle42ofthePRCLaborLaw,
theextendedhoursforadayshallgenerallynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedworkinghoursshallnotexceedthreehoursadayundertheconditionthatthehealthofthePartyBisguaranteed.However,thetotalextensioninamonthshallnotexceed36hours.
C.PartyAshallprovidethePartyAwithlegalholidays,annualleave,marriageleave,funeralleave,homeleave,maternityleave,nursingleave,etc.inaccordancewithrelevantregulationsandpayvacationwagesaccordingtothewagestandardprovidedbythiscontract.
Article4LaborRemuneration
wageofPartyBfornormalworkinghoursshallbepaidpursuanttomodebelowandmaynotlessthantheminimumwagerateintheplacewherethePartyAislocated.

(1)ThewagesofthePartyBfornormalworkinghoursshallbepaidpursuantto;thebeginningwageamountisasRMB/monthorRMB/hour.
(2)ThewagesofthePartyBisasRMB/monthintheprobationaryperiod(theprobationalsalaryshallnotbelessthantheminimumwageofsamepostand80percentofappointedsalaryinthecontract,notlessthantheminimumwagestandardinwherePartyAislocated.);

F.IfPartyAarrangesPartyBtoworkovertime,itshallpayPartyBovertimepayinaccordancewiththePRCLaborLawandProvisionsofGuangdongProvinceonWagePayment,exceptthatPartyBisarrangedforcompensatorytime-offafterhe/shehasbeenarrangedtoworkovertimeonnon-businessday.
Article5SocialInsuranceandFringeBenefits
A.Duringthecontractperiod,PartyA,inaccordancewiththerelevantregulationsofnation,provinceanddistrict,shallpaythepension,medical,unemployment,workinjuryandmaternityinsuranceproceduresforPartyB,andshallpaysocialinsurancefundbasedonpaymentbaseandpaymentratiobyrule.PartyBshallundertakehisownpartofsocialinsurancefund,thepayableamountshallbewithheldbyPartyAfromthePartyB’smonthlywages.PartyAshalltruthfullyinformthesituationofhandlingsocialinsuranceproceduresandwithholdingsocialinsurancepremiumstoPartyB.
B.IncasePartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBaperiodofmedicaltreatmentandsick-leavetreatmentstipulatedbynationalandlocalregulations,paymedicalinsuranceandothermedicalpaymentrelatingtorelevantregulations,andpaysicknesspayordiseasereliefduringspecifiedmedicalperiod,theamountmaybeRMBpermonth(nolessthan80%ofthelocalminimumwagestandard).
Article6LaborProtection,WorkingConditionandProtectionAgainstOccupationalHazards
A.PartyAshallprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordancewithlaborprotectionregulationsofthenationandprovince,andeffectivelyprotectthesafetyandhealthofPartyBduringworkingproduction.IfPartyBmaysufferoccupationalhazardduringproductionprocedures,PartyAshalltruthfullyinformPartyB,andprotectthehealthandrelatedrightsofPartyBstipulatedby“LawofOccupationalDiseasePrevention”.
B.AccordingtothepositionofthePartyB,PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsinconformitywiththerelevantlawsandregulations,andprovidefreephysicalexaminationforPartyBevery(year/season/month)inaccordancewithlaborprotectionprovisions.
C.PartyAmustcarryoutrelevantprovisionsformulatedbythenation,provinceanddistrictforthelaborprotectionandhealth-careworkoffemaleworker..
D.PartyBshallhavetherighttorefusetocarryoutanydangerousoperationforceduponhim/herbyPartyA.ForPartyA'soritsmanager'sbehaviorwhichisindifferenttothesafetyandhealthofPartyB,PartyBmayhavether
