EVEOnline-EndUserLicenseAgreement

GameExperienceMayChangeDuringOnlinePlay

ThankyouforyourinterestinEVE,interactiveonlinegame（"EVE"orthe"Game"）.EVEisofferedbyCCPhf.（"CCP"）,acompanybasedinReykjavik,Icelanddedicatedtothecreationofnextgenerationgames.EVEisamultiplayerroleplayinggamethatallowsthesimultaneousparticipationofplayersaroundtheworld,interactinginthesamegameenvironment.YoumayplayEVEusingCCP'sproprietarysoftware（the"Software"）. UsingtheSoftwareallowsyoutologintoCCP’sclientsystem（the“System”）andinteractwithinthegameenvironmentcreatedbyCCP.ToplayEVE,CCPrequiresthatyoureviewandagreetothefollowingtermsandconditionsofthisEndUserLicenseAgreement（“EULA”）.

ThisEULAdescribesthetermsandconditionsunderwhichyoumay（i）usetheSoftware;（ii）subscribeto,accessanduseEVEOnline,and（iii）accesstheSystem.CCPmayamendthisEULAfromtimetotimebypostinganamendedversionat IfyouacceptthisEULA,thethen-currentversionofthisEULAshallapplyeachtimeyouaccesstheSystemorplayEVE.

Byclickingthe"ACCEPT"buttonbelow（orifyoubypassorotherwisedisablethe"ACCEPT"button,andstillaccessorotherwiseusetheSoftware,theSystemortheGame）,youacceptthetermsandconditionsintheEULA.IfyoudonotacceptthetermsandconditionsintheEULA,youmustclickthe"DECLINE"button,discontinueuseoftheSoftwareandnotaccesstheSystemoruseEVEOnline.IfyouaretheoriginalpurchaserofaboxedversionoftheSoftwareonCD-ROM,youshouldcontacttheretailerforarefund.CCPdoesnotmanufactureordistributetheboxversionoftheGameandisnotresponsibleforrefundinganyfeesrelatingthereto.

1.REQUIREMENTSTOPLAY

ToplayEVE,youmust:

（i）downloadacopyoftheSoftware;（ii）establishavalidaccountwithintheGame（an"Account"）;（iii）obtainandmaintainyourownInternetaccess（InternetaccessisrequiredtoplayEVE;CCPisnotresponsibleforyouraccesstotheInternet）;and（iv）complywiththeEULA.

2.YOURACCOUNT

YoumayestablishmorethanoneAccountforeachcopyoftheSoftwarelicensed.YouarehowevernotallowedtoplayEVEbyusingmorethanoneAccountatthesametime,unlessyoupayasubscriptionfeeforeachoftheAccountsyouintendtouseforthatpurpose.

A.EstablishingaNewAccount

UponestablishinganewAccount,youwillbeentitledtoplayEVE.Onceyouhaveestablishedanaccount,youwillhaveanoptiontopayasubscriptionfee,whichwillallowyoutoenjoyadditionalfeaturesinEVE. 

Onlyanindividual,naturalpersonwhoisanadultor,inthediscretionofsuchanadult,hisorherminorchild,mayestablishanAccount.YouareresponsibleandliableforallactivitiesconductedthroughyourAccount,regardlessofwhoconductsthoseactivities.

YoumaynotshareyourAccountwithanyone,orallowanyoneotherthanyoupersonally（oryourminorchild,ifyouhaveregisteredanAccountonbehalfofyourminorchild）toaccessoruseyourAccount.JointorsharedownershiporuseofanAccountbymorethanoneuserisprohibited.

Accountsmaynotbeusedforbusinesspurposes.AccesstotheSystemandplayingEVEisintendedforyourpersonalentertainment,enjoymentandrecreation,andnotforcorporate,business,commercialorincome-seekingactivities.BusinessentitiesandanyonewhoisactingfororonbehalfofabusinessorforbusinesspurposesmaynotestablishanAccount,accesstheSystemorplayEVE. AccessingtheSystemorusingtheGameforcommercial,businessorincome-seekingpurposesisstrictlyprohibited.

B.PasswordsandNames

Youwillbeaskedtoselectapasswordduringtheregistrationprocess（"Password"）.YoumaynotdiscloseyourPasswordtoanyoneorallowanyonetouseyourPasswordtoaccesstheSystemorplayEVE.YouareresponsibleformaintainingtheconfidentialityofyourPasswordandforanydamage,harm,lostordeletedcharacters,etc.resultingfromyourdisclosure,orallowingthedisclosure,ofanyPassword,orfromusebyanypersonofyourPassword.Youmaynotobtain,attempttoobtain,useorattempttousethepasswordofanyoneelse.YouareresponsibleforrememberingyourAccountinformationandPassword.

Youwillbeassignedaloginnameandacharacternameduringtheregistrationandcharactercreationprocess.YoumaynotallowanyonetouseyourloginnameorcharacternametoaccesstheSystemorplayEVE.Noplayermayusethecharacternameofanotherplayertoimpersonateorfalselyrepresenthisorheridentity.Youmaynotobtain,attempttoobtain,useorattempttousetheloginnameorcharacternameofanyoneelse.

Youareencouragedtouseapseudonym,butyoumaynotchooseanamethatviolatesanyone'strademarks,publicityrightsorotherrights.AcceptanceofapseudonymbytheSystemdoesnotmeanthatyourchosenpseudonymdoesnotviolateanyone'srights.Youareresponsibleforanyliabilityincurredbyyourself,CCPoranyoneelseduetothepseudonymyouchoose.CCPretainstherighttorejectanypseudonymitdetermines,initssolediscretion,isunlawful,indecent,obsceneorotherwiseviolatesstandardsofgoodtaste.

C.Children

（1）ResponsibilityforAccount

MinorchildrenmaynotestablishanAccountwithouttheconsentofaparentorguardian.IftheuserofEVEisaminor,aparentorguardianmustcompletetheregistrationprocesstoestablishanAccount,inwhichcasetheparentorguardiantakesfullresponsibilityforallobligationsundertheEULAandforallactivitiesofthechildusingtheAccount.Ifyouareaparentorguardian,youmaypermitonechildtouseanAccountinsteadofyou（inwhichcaseyoumaynotusethatAccount）.

IfyouestablishanAccount,yourepresentthatyouareanadultandareeitheracceptingtheEULAonbehalfofyourselforonbehalfofyourchild,inwhichlattercaseyouagreetotheEULAwithregardtoyourchildandrepresentthatyouarealsopersonallyboundbytheEULA.

（2）GameRating

EVEhasa"TEEN"rating. Parentsmayfinditinappropriateforusebychildrenundertheageofthirteen（13）.

D.InappropriateConduct/Communication.

CCPmayestablishRulesofConduct（discussedbelow）forplayersaccessingtheSystemandmay,butisnotobligatedto,monitorandtakeactionregardinginappropriateconduct.Nonetheless,itispossiblethatatanytimetheremaybelanguageorothermaterialaccessibleonorthroughtheSystemthatyoumayconsiderinappropriateoroffensivetosomeusers.Youacknowledgethatotherplayersmaytransmitcommunicationsorcontent,oraccesstocontent,thatyoumayconsiderinappropriateorobjectionable.CCPdoesnot,asamatterofpolicy,prescreenthecommunicationsorcontenttransmittedbyeachplayerandisinnowayresponsibleforthecommunicationsandcontenttransmittedbyplayersoftheGame.

3.ACCOUNTTRANSFER/CHARACTERTRANSFER

YouarenotpermittedtotransferyourAccounttoanotherperson.IfyouwishtodiscontinueyourAccountpleaserefertosection6.ofthisEULA.YoumaytransferacharacterfromyourAccounttoanotheraccount,eitherbelongingtoyouoranotherperson.ThistransferoptionisavailablefromtheEVEOnlineAccountManagementwebsiteandissubjecttofeesandthefollowinglimitations:

Youmaynotoffertotransfercharactersexceptyourown,oractasa"broker"orintermediary（forcompensationorotherwise）foranyonewishingtotransferorobtaincharacters.Thetransfereewillobtainallrightstoyourcharacterinasingletransaction,andyouwillretainabsolutelynocontrolorrightsoverthecharacters,itemsorattributesofthatcharacter.Youmaynottransferanycharacterswhoseattributesare,inwholeorinpart,developed,orwhichownitems,objectsorcurrencyobtainedoracquired,inviolationoftheEULA.

Anycharactertransfersorattemptedtransfersnotinaccordancewiththeforegoingtermsisprohibitedandvoid,andshallnotbebindingonCCP.Atransferorattemptedtransferofacharacterisentirelyattheriskofthepartiestosuchtransaction.CCPisnotliabletoanyperson（whethertransferor,transfereeorotherwise）foranyacts,omissions,statements,representations,defaultsorliabilitiesofthepartiesinconnectionwithsuchatransaction.

4.FEESANDPAYMENTTERMS

YouarenotrequiredtopayafeetoplayEVE. Youmayhoweverberequiredtopayadownloadfeeand/orasubscriptionfeetoaccessandusecertainfeaturesofEVE,whichwouldotherwisebeunavailable. YoualsomaypurchaseitemsforusewithintheGameinreturnforspecificitemcharges. Youwillbeinformedofanyapplicabledownloadfees,subscriptionfees,itemcharges,oranyotherfees,togetherwiththeirrespectivepaymentterms,duringtheregistrationprocessand,solelywithrespecttoitemsforusewithintheGame,immediatelypriortopurchase. ThecurrentfeesandpaymenttermsmaybeviewedintheEVEOnlineHelpCenterandareincorporatedinthisEULAbyreference. Forexistingplayers,feesalsomaybeviewedinyourAccountManagementwebsite,foundat CCPmayamendthefeesandpaymenttermsatanytime.

AllfeesarepayableinU.S.Dollars,Euros,poundsSterling,Yen,orsuchothercurrencyasstatedinthepaymentterms. Allfeesarenon-refundableunlessexpresslystatedotherwiseinthisEULA. Bypayingsuchfees,youwillenjoyenhancedgameplayoptionsandadditionalfeatureswithinEVEduringtheperiodwhichfeesarepaid.Ifyoudonotwishtopayanysuchfeesorcancelyourpaidsubscription,thefeaturesavailabletoyouwhileplayingEVEwillbelimited.
