GeneralProvisions

Article1ThisLawisenactedinordertoprotectpatentrightsforinventions-creations，encourageinvention-creation，tofacilitatethewideapplicationofinventions-creations,promotetheprogressandinnovationofscienceandtechnology，andmeettheneedsofthesocialistmodernizationdrive.

Article2ForthepurposeofthisLaw,"

invention-creation"

meansinventions,utilitymodelsanddesigns.

Article3ThepatentadministrationdepartmentundertheStateCouncilisresponsibleforthepatentworkthroughoutthecountry.Itacceptsandexaminespatentapplicationsandgrantspatentrightsforinventions-creationsinaccordancewithlaw.

Theadministrativeauthorityforpatentaffairsunderthepeople'

sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentareresponsiblefortheadministrativeworkconcerningpatentsintheirrespectiveadministrativeareas.

Article4Ifaninvention-creationforwhichapatentisappliedinvolvesnationalsecurityorothervitalinterestsoftheStatethatrequiresecrecy,themattershallbetreatedinaccordancewiththerelevantprovisionsoftheState.

Article5Nopatentrightshallbegrantedforanyinvention-creationthatviolatesthelawsoftheState,goesagainstsocialmoralsorisdetrimentaltothepublicinterest.

Article6Aninvention-creation,madebyapersoninexecutionofthetasksoftheentitytowhichhebelongs,ormadebyhimmainlybyusingthematerialandtechnicalmeansoftheentityisaserviceinvention-creation.Foraserviceintention-creation,therighttoapplyforapatentbelongstotheentity.Aftertheapplicationisapproved,theentityshallbethepatentee.

Foranon-serviceinvention-creation,therighttoapplyforapatentbelongstotheinventororcreator.Aftertheapplicationisapproved,theinventororcreatorshallbethepatentee.

Inrespectofaninvention-creationmadebyapersonusingthematerialandtechnicalmeansofanentitytowhichhebelongs,wheretheentityandtheinventororcreatorhaveenteredintoacontractinwhichtherighttoapplyforandownapatentisprovidedfor,suchaprovisionshallapply.

Article7Noentityorindividualmaysuppresstheapplicationofaninventorordesignerforapatentinrespectofaninvention-creationthatisnotjob-related.

Article8Foraninvention-creationjointlymadebytwoormoreentitiesorindividuals,ormadebyanentityorindividualinexecutionofacommissiongiventoitorhimbyanotherentityorindividual,therighttoapplyforapatentbelongs,unlessotherwiseagreedupon,totheentityorindividualthatmade,ortotheentitiesorindividualsthatjointlymade,theinvention-creation.Aftertheapplicationisapproved,theentityorindividualthatappliesforitshallbethepatentee.

Article9Iftwoormoreapplicantsapplyseparatelyforapatentonthesameinvention-creation,thepatentrightshallbegrantedtothepersonwhoappliedfirst.

Article10Therightofpatentapplicationandthepatentrightitselfmaybeassigned.

IfaChineseentityorindividualwishestoassignarightofpatentapplicationorapatentrighttoaforeigner,itorhemustobtaintheapprovaloftherelevantcompetentdepartmentundertheStateCouncil.

Wheretherighttoapplyforapatentorthepatentrightisassigned,thepartiesshallconcludeawrittencontractandregisteritwiththepatentadministrationdepartmentundertheStateCouncil.ThepatentadministrationdepartmentundertheStateCouncilshallannouncetheregistration.Theassignmentshalltakeeffectasofthedateofregistration.

Article11Afterthegrantofthepatentrightforaninventionorutilitymodel,exceptwhereotherwiseprovidedforinthisLaw,noentityorindividualmay,withouttheauthorizationofthepatentee,exploitthepatent,thatis,make,use,offertosell,sellorimportthepatentedproduct,orusethepatentedprocess,oruse,offertosell,sellorimporttheproductdirectlyobtainedbythepatentedprocess,forproductionorbusinesspurposes.

Afterthegrantofthepatentrightforadesign,noentityorindividualmay,withouttheauthorizationofthepatentee,exploitthedesign,thatis,make,sellorimporttheproductincorporatingitsorhispatenteddesign,forproductionorbusinesspurposes.

Article12ExceptasprovidedforinArticle14ofthisLaw,anyentityorindividualexploitingthepatentofanothermustconcludeawrittenlicensingcontractwiththepatenteeandpaythepatenteeafeefortheexploitationofitsorhispatent.Thelicenseeshallnothavetherighttoauthorizeanyentityorindividualotherthanthatreferredtointhecontracttoexploitthepatent.

Article13Aftertheapplicationforaninventionpatenthasbeenpubliclyannounced,theapplicantmayrequiretheentitiesorindividualsexploitingtheinventiontopayanappropriatefee.

Article14Whereanypatentforinvention,whichbelongstoanyState-ownedenterpriseorinstitution,isofgreatsignificancetotheinterestsoftheStateorthepublic,thecompetentdepartmentsconcernedundertheStateCouncilandthepeople'

sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentmay,afterapprovalbytheStateCouncil,decidethatthepatentedinventionbewidelyappliedwithintheapprovedlimits,andallowdesignatedentitiestoexploitthatinvention.Theexploitingentityshall,accordingtotheregulationsoftheState,payafeeforexploitationtothepatentee.

AnypatentforinventionbelongingtoaChineseindividualoranentityundercollectiveownership,whichisofgreatsignificancetotheinterestsoftheStateorthepublicandneedstobewidelyapplied,maybetreatedalikebymakingreferencetotheprovisionsoftheprecedingparagraph.

Article15Thepatenteeshallhavetherighttoaffixapatentmarkingandindicatethepatentnumberonthepatentedproductoronthepackagingofthatproduct.

Article16Theentitythatisgrantedapatentrightshallrewardtotheinventororcreatorofaserviceinvention--creationand,uponexploitationofthepatentedinvention-creation,shallgivetheinventororcreatorareasonableremunerationbasedontheextenttheinvention-creationisappliedandtheeconomicbenefitsityields.

Article17Aninventorordesignershallhavetherighttonamehimselfassuchinthepatentdocument.

Article18Ifaforeigner,foreignenterpriseorotherforeignorganizationhavingnoregularresidenceorplaceofbusinessinChinafilesanapplicationforapatentinChina,theapplicationshallbehandledunderthisLawinaccordancewithanyagreementconcludedbetweenthecountrytowhichtheapplicantbelongsandChina,oranyinternationaltreatytowhichbothcountriesareparty,oronthebasisoftheprincipleofreciprocity.

Article19Whereanyforeigner,foreignenterpriseorotherforeignorganizationhavingnohabitualresidenceorbusinessofficeinChinaappliesforapatent,orhasotherpatentmatterstoattendto,inChina,heoritshallappointapatentagencydesignatedbythepatentadministrationdepartmentundertheStateCounciltoactashisoritsagent.

IfanyChineseentityorindividualappliesforapatentorhasotherpatentmatterstoattendtointhecountry,itorhemayentrustapatentagencytoactonitsorhisbehalf.

Thepatentagencyshallcomplywiththeprovisionsoflawsandadministrativeregulations,andhandlepatentapplicationsandotherpatentmattersaccordingtotheinstructionsofitsclients.Inrespectofthecontentsofitsclients'

inventions-creations,exceptforthosethathavebeenpublishedorannounced,theagencyshallbeartheresponsibilityofkeepingthemconfidential.TheadministrativeregulationsgoverningthepatentagencyshallbeformulatedbytheStateCouncil.

Article20WhereanyChineseentityorindividualintendstofileanapplicationinaforeigncountryforapatentforinvention-creationmadeinChina,itorheshallfilefirstanapplicationforpatentwiththepatentadministrationdepartmentundertheStateCouncil,appointapatentagencydesignatedbythesaiddepartmenttoactasitsorhisagent,andcomplywiththeprovisionsofArticle4ofthisLaw.

AnyChineseentityorindividualmayfileaninternationalapplicationforpatentinaccordancewithanyinternationaltreatyconcernedtowhichChinaisparty.Theapplicantfilinganinternationalapplicationforpatentshallcomplywiththeprovisionsoftheprecedingparagraph.
