ChapterIGeneralProvisions

Thefirstistoguaranteethebasiclivingstandardofurbanandruralresidentsinourcity,topromotetheintegrationofurbanandruralsocialassistance,accordingtotheStateCouncil"

cityresidentsProtectionOrdinance"

and"

cityofHubeiprovinceresidentsminimumlivingsecurityimplementationmeasures"

combinedwiththeactualcity,theenactmentofthisapproach.

Second,thecity'

sadministrativeareasofurbanandruralresidentsminimumlivingsecurity（hereinafterreferredtoasminimum）workandsupervisionandmanagementofthesemeasures.

Thirdminimumlivingstandardsshouldfollowthefollowingprinciples:

（I）principlesofopenness,fairnessandimpartiality;

（two）theprincipleofintegrationofurbanandruralareasandoverallplanningofurbanandruralareas;

（three）theprincipleofadaptingstandardsofprotectiontothelevelofeconomicandsocialdevelopment;

（four）theprincipleofcombiningnationalsecuritywithsocialassistanceandself-helpthroughlabor;

（five）theprincipleofcombininginsurancewithemploymentshouldbeguaranteed.

Fourthmunicipal（District）civilaffairsdepartments,subdistrictoffices（TownshipPeople'

sGovernment）fortheminimummanagementauthority.

Municipalanddistrictcivilaffairsdepartmentsareresponsibleforthemanagementandapprovalofminimumlivingallowancesintheirrespectivedistricts.Theyareresponsiblefortheformulationofsubsistenceallowancespolicies,guidingandsupervisingtheworkofsubsistenceallowances,andinvestigatingtheillegalactivitiesconcerningthesubsistenceallowances.

ThesubdistrictofficesandtheTownshipPeople'

sgovernmentsareresponsibleforthedailyworkofaccepting,examiningandguaranteeingthemanagementandserviceofsubsistenceallowancesintheirrespectivedistricts.

Fifthcity（District）people'

sgovernment"

toraisemoneytodo"

intheofficeofthestreets（TownshipPeople'

sGovernment）theestablishmentofsocialassistanceservicestation,helpstreetoffices（TownshipPeople'

sGovernment）responsibleforguaranteeingtheacceptance,auditandmanagementservicesdailylivingobject.Thesocialreliefservicestationisunderthedualleadershipofthemunicipal（District）civilaffairsdepartmentandtheSubdistrictOffice（TownshipPeople'

sGovernment）inadministrationandbusiness.

Sixthagriculture,supervision,finance,humanresourcesandsocialsecurity,health,auditing,statistics,prices,industryandcommerce,taxationandotherdepartmentswithinthescopeoftheirrespectivedutiestotheminimumtargettogivethenecessarysupport,assistthedepartmentsofcivilaffairssystem.

TheseventhmunicipalandDistrictPeople'

sgovernmentsshallcommendandrewardtheunitsandindividualswhohavemadeoutstandingachievementsintheworkofguaranteeingsubsistenceallowancesinaccordancewiththerelevantprovisions.

Thesecondchapter,theobjectofprotectionandtherightsandobligations

Eighthwhoeverholdsthecityresidentaccountsinthecityareahavelegalpermanentresidenceandresidenceformorethanayear（includingoneyear,hereinaftercalledtheresident）,andfamilymemberslivingtogetherpercapitaincomelowerthantheminimumlivingstandardoftheresidentscanapplyforsubsistenceallowances.

Ninthoftheapplicantsmeettheminimumtreatmentprovisionsofarticleeighthofthesemeasuresshouldbeconsideredforthefamilypropertystatus,thestatusoffamilyproperty,consumptionlevelisobviouslyhigherthantheminimumstandard,withouttheapprovalofthetreatmentoflowoftheenjoymentoftheprovisionsofthemeasures.

Thehouseholdpropertystatusandconsumptionlevelareobviouslyhigherthanthoseofthelocalminimumlivingstandard,whichshallbejointlydeterminedbythemunicipalcivilaffairsdepartmentinconjunctionwiththemunicipalfinance,priceandstatisticalinvestigationdepartments.

Familypropertyandcomparableincomeshallbeverifiedbythecityandfamilyeconomicstatusverificationinstitution.

Thehouseholdincomeoftenthurbanandruralresidentsreferstothetotalmonetaryincomeandphysicalincomeofthefamilymemberswholivetogether.Urbanresidentspercapitamonthlyfamilyincome,accordingtothenumberoftheapplicantfamilyapprovedthreemonthsbeforetheaveragemonthlyhouseholdincomedividedbyapproved;

percapitanetincomeofruralhouseholds,determinedbytheapplicationofaveragemonthlyannualhouseholdnetincomedividedbytheapprovedfamilypopulation.

Eleventhapplyforsubsistenceallowancestreatmentofresidentslivingtogetherfamily,isinaccordancewiththerelevantprovisionsofthe"

marriagelaw"

inPeople'

sRepublicofChina,togetherwiththeapplicant'

slifehaslegalsupport,custody,supporttherelationshipbetweenfamilymembers.

Infull-timeschools,studentsareincludedinthefamilypopulation;

activeservicemeninthearmyandprisonersinprisonandreeducationthroughlaborplacesandreeducationthroughlabourarenotincludedinthehouseholdpopulation.

Familylifeisdifficult（theactuallivingstandardsinlow-incomefamiliesbelow）ofadults,severedisabledpeoplecanapplyforaminimumallowancewithotherfamilymembers.

Twelfthminimumassuranceapplicantsandsubsistenceallowancesenjoythefollowingrights:

（1）toaskthelowmaintenancemanagementinstitutionsandtheirentrustedinstitutionstoexplainthepolicyofguaranteeingtheminimumlivingallowances;

（two）theapprovalofthemanagementoftheminimumlivingallowance,thetreatmentofthelowestlivingallowances,thereductionandterminationofthesubsistenceallowances,

Ifapersonisnotsatisfiedwiththetreatmentofaminimumlivingallowanceoranadministrativesanction,hemayapplyforadministrativereconsiderationorbringanadministrativelawsuitinaccordancewiththelaw;

（three）enjoypreferentialpoliciesandsupportinaccordancewiththeregulations.

Thirteenthminimumlivingstandardsshouldfulfillthefollowingobligations:

（a）intheemploymentageprescribedbythestatehavetheabilitytoworkbutnottheemploymentofurbanresidents,oughttoaccountforthelocationofthepublicemploymentserviceagenciestoparticipateintheregistrationoftheunemployed,theresidentscommitteeorganizationofpubliccommunityserviceworkandoccupationskilltraining,employmentshallnotrefusewithoutjustification;

（two）ruralresidentswithworkingabilityshouldengageinproductivelabour;

（three）providingrealhouseholdincomeandpropertystatus;

（four）toactivelycooperatewiththecivilaffairsdepartmentstoinvestigatethechangesoffamilymembers,incomeandpropertyinatimelymanner,andtoundergoregularreview.

Minimumincomeapplicantsshouldproviderealincomeandpropertystatus,andtaketheinitiativetocooperatewiththecivilaffairsdepartments.

Thethirdchapteristheexaminationandapprovalprocedureofsubsistenceallowances

Fourteenthapplyforsubsistenceallowances,headedbyorhisagenttotherelateddocuments,tostreetoffices（TownshipPeople'

sGovernment）toapply,filloutthe"

Ezhousocialrelieftreatmentapplication"

.Therelevantmaterialslistandstyletextshallbeseparatelyprescribedbythemunicipalcivilaffairsdepartment.

Fifteenthminimumtreatmentapprovalprocess:

（a）Streetoffices（TownshipPeople'

sGovernment）receivedtheapplicationmaterialssubmittedbytheapplicant,shallcompletetheexaminationwithin1workingdays,tomeettheconditionsofadmissibilityshouldbeaccepted;

donotmeettheconditionsforacceptance,shallnotifytheapplicantinwritingandexplainthereasons.

（two）Streetoffices（TownshipPeople'

sGovernment）byguaranteeingtheapplicant'

sapplication,shouldbetimelypublicity,andcompletetheinvestigationandverificationandotherrelatedworkin7workingdays.Toinvestigateandverifythecommentsbytheofficeofthestreets（TownshipPeople'

sGovernment）representatives,communitycommittees（Village）,onbehalfofresidence（Village）threepartydemocraticappraisalcommitteecomposedofrepresentativesofthepeople'

sdemocraticappraisal,democraticappraisalqualifiedapprovalform"

fillin"

EzhouCitysubsistenceallowances,togetherwithrelevantdocumentssubmittedtothemunicipal（District）subsistenceallowancesthemanagementoftheexaminationandapprovalauthoritiesforapproval,andpostthepublicagain.Ifthedemocraticappraisalisnotreported,theapplicantshallnotifytheapplicantinwritingandexplainthereasons.

（three）thecity（District）thestandardmanagementoftheexaminationandapprovalauthorityshall,within7workingdaystocompletethematerialreview,investigationandverificationandapprovaloftheexaminationandapprovalofcollectivecollectivework,meettheminimumconditionsfortheapprovaloftheapplicantissued"

Ezhoucityresidents,socialassistance,socialcard"

fundsforpaymentprocedures,andapprovaloftheresultstothesocietypublicity;

withoutapproval,shallnotifytheapplicantinwritingandexplainthereasons.
