TheEmployeesofalltypesofenterprisesandthehiredworkersofsoletradersinthePeople'

sRepublicofChinashallhavetherighttoenjoythebenefitsofwork-relatedinjuryinsuranceinaccordancewiththeprovisionshereof.

Article3　Collectionandpaymentofwork-relatedinjuryinsurancepremiumsshallbecarriedoutinaccordancewiththeprovisionsintheCollectionandPaymentofSocialInsurancePremiumsTentativeRegulationsregardingcollectionandpaymentofbasicoldageinsurancepremiums，basicmedicalinsurancepremiumsandunemploymentinsurancepremiums.

Article4　AnEmployershallannouncewithintheworkunittherelevantdetailsofitsparticipationinwork-relatedinjuryinsurance.

AnEmployeranditsEmployeesshallabidebythelawsandregulationsregardingsafeproductionandpreventionandtreatmentofoccupationaldiseases，implementsafetyandhealthregulationsandstandards，preventoccurrenceofwork-relatedinjuryaccidentsandavoidandmitigatetheharmsofoccupationaldiseases.

IfanEmployeesuffersfromwork-relatedinjury，theEmployershalladoptmeasurestoensurethatsuchEmployeereceivestimelyrescueandtreatment.

Article5　TheadministrativedepartmentoflaborsecurityoftheStateCouncilshallbeinchargeoftheworkofwork-relatedinjuryinsurancethroughoutthecountry.

Theadministrativedepartmentsoflaborsecurityofalllevelsoflocalpeople'

sgovernmentsatthecountylevelandaboveshallbeinchargeofwork-relatedinjuryinsuranceworkwithintheirrespectiveadministrativeareas.

ThesocialinsuranceagenciesestablishedbytheadministrativedepartmentsoflaborsecurityinaccordancewithrelevantprovisionsoftheStateCouncil（Agency/Agencies）shallundertakethepracticalaffairsofwork-relatedinjuryinsurance.

Article6　AdministrativedepartmentsoflaborsecurityandotherdepartmentsshallseektheopinionoftradeunionsandrepresentativesofEmployerswhenformulatingpoliciesandstandardsforwork-relatedinjuryinsurance.

PARTTWO　WORK-RELATEDINJURYINSURANCEFUNDS

Article7　Work-relatedinjuryinsurancefundsshallbecomposedofwork-relatedinjuryinsurancepremiumspaidbyEmployers，interestonwork-relatedinjuryinsurancefundsandotherfundspaidintothework-relatedinjuryinsurancefundsinaccordancewithlaw.

Article8　Thepremiumrateforwork-relatedinjuryinsuranceshallbedeterminedontheprinciplesthatreceiptbedeterminedonthebasisofpaymentandthatreceiptandpaymentbebalanced.

TheStateshalldeterminepremiumratedifferentialsbetweenindustriesaccordingtothedegreeofrisksofwork-relatedinjuriesindifferentindustries，andshalldetermineseveraltiersofpremiumrateswithineachindustryaccordingtocircumstancessuchastheuseofwork-relatedinjuryinsurancepremiumsandthefrequencyofoccurrenceofwork-relatedinjuries.Inter-industrypremiumratedifferentialsandintra-industrypremiumratetiersshallbeformulatedbytheadministrativedepartmentoflaborsecurityoftheStateCouncilandshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

TheAgencyforapoolingregionshalldeterminetheworkunitpayablepremiumrateforanEmployeronthebasisofsuchcircumstancessuchasuseofwork-relatedinjuryinsurancepremiumsandfrequencyofoccurrenceofwork-relatedinjuriesoftheEmployer，andthecorrespondingpremiumratetierapplicabletotheindustrytowhichtheEmployerbelongs.

Article9　TheadministrativedepartmentoflaborsecurityoftheStateCouncilshallperiodicallyobtainthedetailsofreceiptandpaymentofwork-relatedinjuryinsurancefundsofallpoolingregionsthroughoutthecountry，andshallproposeadjustmenttotheinter-industrypremiumratedifferentialsandtheintra-industrypremiumratetiersinatimelymanner.SuchadjustmentshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

Article10　Employersshallpaywork-relatedinjuryinsurancepremiumsontime.Employeesshallnotpaywork-relatedinjuryinsurancepremiumsthemselves.

Theamountofwork-relatedinjuryinsurancepremiumpayablebyanEmployershallbetheproductofthetotalpayrolloftheEmployeesoftheworkunitandtheworkunitpayablepremiumrate.

Article11　Work-relatedinjuryinsurancefundsshallbegraduallyhandledandcoordinatedatprovinciallevel.

Aninter-regionindustry 

anindustrywitharelativelyhighlevelofproductionmobilitymayparticipatefromanotherregioninwork-relatedinjuryinsuranceinapoolingregionbyadoptingamethodofrelativeconcentration.ThespecificproceduresshallbeformulatedbytheadministrativedepartmentoflaborsecurityoftheStateCouncilinconjunctionwiththedepartmentinchargeoftherelevantindustry.

Article12　Work-relatedinjuryinsurancefundsshallbedepositedintoadedicatedfinanceaccountforsocialsecurityfundsforbenefitsofwork-relatedinjuryinsurance，assessmentofworkcapabilityandpaymentofotherexpensesforwork-relatedinjuryinsurancestipulatedherein.Noworkunit 

individualmayusethework-relatedinjuryinsurancefundsforinvestmentandoperation，construction 

renovationofofficesite，distributionofbonuses， 

divertsuchfundstootheruses.

Article13　Acertainratioofwork-relatedinjuryinsurancefundsshallbemaintainedasreservesforpaymentofwork-relatedinjuryinsurancebenefitsintheeventofmajoraccidentsinthepoolingregion.Incaseofashortageofreserves，thepeople'

sgovernmentofthepoolingregionshalladvancethepayment.Thespecificratioofreservestothetotalamountoffundsandtheproceduresfortheuseofreservesshallbestipulatedbythepeople'

sgovernmentsofprovinces，autonomousregions 

municipalitiesdirectlyunderthecentralgovernment.

PARTTHREE　DETERMINATIONOFWORK-RELATEDINJURY

Article14　AnEmployeeshallbedeterminedashavingawork-relatedinjuryif：

1.heisinjuredinanaccidentatworkduringworkinghoursintheworkplace；

2.heisinjuredinanaccidentwhileengaginginpreparatory 

finishing-upworkrelatedtoworkbefore 

afterworkinghoursintheworkplace；

3.heisinjuredbyviolence 

inotheraccidentinhisperformanceofjobdutiesduringworkinghoursintheworkplace；

4.hesuffersfromanoccupationaldisease；

5.heisinjuredatwork 

hiswhereaboutsbecameunknowninanaccident，duringwork-relatedtravel；

6.heisinjuredinamotorvehicleaccidentwhilegoingto 

returningfromwork；

or

7.heisinothercircumstancesthatshallbedeterminedaswork-relatedinjuryaccordingtotheprovisionsoflawsandadministrativeregulations.

Article15　AnEmployeeshallbedeemedashavingawork-relatedinjuryif：

1.hediesimmediately 

within48hoursafteremergencytreatmentforadiseasesuddenlyarisingduringworkinghoursintheworkplace；

2.heisinjuredinanacttoprotectnationalinterests 

publicinterestssuchasemergencyrescueanddisasterrelief；

3.heisinjuredanddisabledinwar 

ondutywhileinmilitaryserviceandhasobtainedarevolutionaryinjuredanddisabledsoldiercertificate，andsuffersfromarelapseoftheoldinjurywhilebeingemployedbytheEmployer.

WhereanEmployeeisinthecircumstanceofItem

（1） 

（2）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsinaccordancewiththerelevantprovisionshereof.WhereanEmployeeisinthecircumstanceofItem（3）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsotherthanthelumpsumdisabilityallowanceinaccordancewiththerelevantprovisionshereof.

Article16　AnEmployeeshallnotbedetermined 

deemedashavingwork-relatedinjuryif：

1.heisinjured 

hediesasaresultofcommissionofcrime 

violationofpublicsecurityadministration；

2.heisinjured 

hediesasaresultofintoxication；

3.heinflictsharmonhimself 

commitssuicide.

Article17　IfanEmployeeisinjuredinanaccident 

diagnosed 

certifiedashavingoccupationaldiseasepursuanttotheprovisionsofthePreventionandTreatmentofOccupationalDiseasesLaw，hisworkunitshallfileanapplicationfordeterminationofwork-relatedinjurytotheadministrativedepartmentoflaborsecurityoftherelevantpoolingregionwithin30daysofthedateofoccurrenceoftheaccidentalinjury 

thedateofdiagnosis 

certificationoftheoccupationaldisease.Inspecialcircumstances，thetimelimitforapplicationmay，subjecttotheconsentoftheadministrativedepartmentoflaborsecurity，beextendedasappropriate.

IftheEmployerfailstofileanapplicationfordeterminationofwork-relatedinjurypursuanttotheprecedingparagraph，theEmployeewithwork-relatedinjury，hisdirectly-relatedfamilymembers 

thetrade

maydirectlyfileanapplicationfordeterminationofwork-relatedinjurytotheadministrativedepartmentoflaborsecurityofthepoolingregioninwhichtheEmployerislocatedwithinoneyearofthedateofoccurrenceoftheaccidentalinj
