按照《中华人民共和国劳动法》、《中华人民共和国劳动合同法》及其他有关的法律、法规、政策，甲乙双方根据平等自愿、协商一致的原则，签订本合同。
双方共同信守本合同所列各条款，并确认本合同为双方解决争议时的依据。

andotherrelatedlaws,thelawsandregulations,thepolicy,armorsecondgradebothsidesactaccordingtotheequalitytobevoluntary,theconsultativeconsistentprinciple,signsthiscontract.Bothsidesabidebythiscontracttoarrangeinordervariousprovisionstogether,andconfirmedthatthiscontractsolvestimethedisputebasisforbothsides.
一、合同期限和试用期限First,durationofcontractandtestdeadline
甲、乙双方选择以下第贰种形式确定本合同期限：

1、无固定期限，自_____年_____月_____日起至法定或约定终止情形出现时即行终止。

2、固定期限，自_年_月__日起至年_月__日止，合同期为年，本劳动合同自生效之日起的前个月（即自年月日至年月日止）内为试用期。
乙方应在年月日前到岗，乙方未依约到岗的，本合同自到岗日满后自动失效，但甲方认可的除外。
由此给甲方造成的损失，应由乙方全额承担。
2nd,fixeddeadline,from_Year_Month__datetoYear_Themonth__datestops,thecontractperiodisTheyear,thislaborcontractbeforebecomingeffectivedateMonth（i.e.fromYearMonthJapantoYearThemonthdatestops）inisaprobationperiod.ThesecondpartyshouldinYearMonthTheotherdayarrivedatthehillock,thesecondpartyhasnotarrivedatthehillockasagreedthatthiscontractafterarrivingatthehillockdatefullautomaticexpiration,butthefirstpartyapprovedexception.Fromthislosswhichcreatestothefirstparty,shouldundertakebythesecondpartysumtotal.
3、乙方必须在合同生效之日起二周内，将劳动手册等交给甲方，以便甲方为其办理录用手续，否则相关责任由乙方承担。
3rd,thesecondpartymust,inthecontractbecomeseffectiveindatefortwoweeks,thelaborhandbookandsoonwillgivethefirstparty,sothatthefirstpartycangothroughthehireformalitiesforit,otherwisetherelatedresponsibilityundertakesbythesecondparty.
二、工作岗位及职责Second,operatingpostandresponsibility
1、依据乙方求职承诺，甲方聘用乙方在甲方所属工作，具体工作内容见乙方所签字确认的“岗位职责与考核”（见附件）。
1st,seeksemploymentthepledgebasedonthesecondparty,thefirstpartyhiresthesecondpartytoberespectiveinthefirstpartyThework,worksthecontenttoseesecondpartyspecificallytosigntheconfirmation“thepostresponsibilityandtheinspection”（seesappendix）.
2、合同期内，甲方有权根据工作、生产经营需要，临时安排乙方从事其他岗位工作，时限为不超过六个月。
2nd,inthecontractperiod,thefirstpartyisauthorizedtoactaccordingtothework,theproductionoperationneed,thetemporaryarrangementssecondpartyisengagedinotherpostwork,thetimelimitfordoesnotsurpassforsixmonths.
3、乙方必须按照双方所确定的岗位职责，按时、按质、按量完成工作任务，甲方将依据考核制度进行考核，如乙方不能通过基本考核要求则甲方有权依相关规定处理。

4、甲方因生产和工作需要，依据乙方的专业、特长、工作能力和表现，需调整乙方工作岗位及其工作报酬的，原则上应协商一致，但以下情况除外：
4th,thefirstpartybecauseoftheproductionandthejobrequirement,restsonsecondparty'
sspecialty,thespecialskill,workingabilityandtheperformance,mustadjustthesecondpartyoperatingpostandtheworkreward,inprincipleshouldconsultunanimously,butfollowingsituationexception:
（1）甲方因生产经营服务需要，产业、产品结构调整及工艺规程、组织机构设置等情况发生变动需调动乙方工作岗位时，乙方应予接受；
（2）乙方因技能、身体等因素达不到生产服务、工作质量、产量等指标，不能胜任工作的。

（2）thesecondpartyfactorsandsoonskill,bodycannotachievetargetsandsoonproducerservices,workquality,output,cannotbecompetentthework.
5、乙方承诺：
5th,thesecondpartypledged:
（1）接受甲方所制定的“岗位职责与考核”，认真履行岗位职责，完成工作任务，接受甲方考核。
如不符合“岗位职责与考核”的要求，服从甲方的岗位调整、薪酬调整或其他处理。

（2）”，随时调整乙方的工作岗位和职责，并同意甲方可按新的工作岗位来调整乙方的薪酬。
如乙方不服从甲方调整，则甲方有权解除劳动合同。

三、工作时间、劳动报酬和福利待遇Third,theoperatingtime,TradeUnionNewspaperrespondwithapoemthewelfaretreatment
1、具体上下班时间按甲方规定的作息时间执行。
甲方因工作需要安排乙方延长工作时间或节假日加班加点的，乙方应服从甲方统一安排。
乙方加班须征得甲方确认同意，否则不视为加班。
1st,theconcretedrivetimethedailyscheduleexecutionwhichstipulatedaccordingtofirstparty.Becausethefirstpartythejobrequirementarrangesthesecondpartytolengthentheoperatingtimeortheholidayworksovertime,thesecondpartyshouldobeythefirstpartyunifiedagreement.Thesecondpartyworksovertimemustsolicitthefirstpartytoconfirmtheagreement,otherwisedoesnotregardasworkingovertime.
2、甲方确定的发薪日期为每月5日。
甲方根据本企业的工资分配方案，乙方的工作表现及能力，确定乙方的月工资报酬为元/月（试用期薪资为元/月）。
其他的浮动收入部分：
视考核、试用状况、公司经营状况经另行规定后发放；
销售提成：
按公司销售提成管理制度执行。
甲方支付乙方的工资为税前工资。

swagesbeforethetaxthewages
3、甲方可根据实际业务经营状况以及乙方的工作业绩、奖罚记录、职位变化，随时调整乙方的工资水平和工资结构，并及时通知乙方。
乙方愿意接受甲方的工资调整。

sworkachievement,theawardandpenaltyrecord,thepositionchange,momentarilyadjustssecondparty'
swagelevelandthewagestructure,andinformsthesecondpartypromptly.Thesecondpartyiswillingtoacceptfirstparty'
swagesadjustment.
4、甲、乙双方按国家和本市的有关规定缴纳各项社会保险费用。
4th,thearmor,thesecondgradebothsidespayeachsocialsecurityfeeaccordingtonationalandthiscityconcernedrequirements.
5、乙方在合同期内享有国家和甲方规定的各种补贴、福利待遇等。

6、甲方为乙方提供符合国家规定的劳动保护、劳动条件和职业危害防护的措施。

四、劳动纪律和奖惩办法Fourth,labordisciplineandrewardsandpunishmentmeans
1、乙方应自觉遵守国家法律、法规和社会公德，遵守职业道德，自觉维护甲方声誉。
1st,thesecondpartyshouldonowninitiativeabidebythelawcountry,thelawsandregulationsandcommoncourtesy,observestheoccupationalethics,thedeterminationdefendsthefirstpartyprestige.
2、乙方应严格遵守甲方制订的各项规章制度、工作程序、工作纪律，包括《员工手册》等中写明的各项规定和要求。
甲方对模范遵守劳动纪律、规章制度或违反劳动纪律、规章制度的乙方，可以进行奖励或处罚。

.Thefirstpartyobservesthelabordiscipline,therulesandregulationstothemodelorviolatesthelabordiscipline,therulesandregulationssecondparty,maycarryontherewardorthepunishment.
3、乙方在担任领导职务期间，对其下属负有领导责任，并承担其下属工作过错或过失造成的经济损失的连带责任。
3rd,thesecondpartyisholdingthepostofleadershippositionperiod,hastheleadershipresponsibilitytoitssubordinate,andundertakesitssubordinatetoworktheeconomiclossjointandseveralliabilitywhichthemistakeortheerrorcreate.
4、甲方规章制度的认可条款
甲、乙双方在签订合同后，即进行职前培训。
乙方将有机会了解、熟悉甲方甲方整个管理规章体系。
乙方应无条件认可管理规章体系，双方都有按规章执行和保障的义务。

五、商业秘密保护Fifth,businesssecretprotection
1、乙方应保守甲方的商业秘密。
“商业秘密”包括但不限于甲方客户信息，供应商信息，产品设计，商品价格，销售数据，财务资料，人事资料等。
