StatuteoftheCourt

TheStatuteoftheInternationalCourtofJusticeisannexedtotheCharteroftheUnitedNations,ofwhichitformsanintegralpart.ThemainobjectoftheStatuteistoorganizethecompositionandthefunctioningoftheCourt.

TheStatutecanbeamendedonlyinthesamewayastheCharter,i.e.,byatwo-thirdsmajorityvoteintheGeneralAssemblyandratificationbytwo-thirdsoftheStates（Art69）.

ShouldtheICJconsideritdesirableforitsStatutetobeamended,itmustsubmitaproposaltothiseffecttotheGeneralAssemblybymeansofawrittencommunicationaddressedtotheSecretary-GeneraloftheUnitedNations（Art70）.However,therehashithertobeennoamendmentoftheStatuteoftheCourt.

Article1

TheInternationalCourtofJusticeestablishedbytheCharteroftheUnitedNationsastheprincipaljudicialorganoftheUnitedNationsshallbeconstitutedandshallfunctioninaccordancewiththeprovisionsofthepresentStatute.

CHAPTERI-ORGANIZATIONOFTHECOURT

Article2

TheCourtshallbecomposedofabodyofindependentjudges,electedregardlessoftheirnationalityfromamongpersonsofhighmoralcharacter,whopossessthequalificationsrequiredintheirrespectivecountriesforappointmenttothehighestjudicialoffices,orarejurisconsultsofrecognizedcompetenceininternationallaw.

Article3

1.TheCourtshallconsistoffifteenmembers,notwoofwhommaybenationalsofthesamestate.

2.ApersonwhoforthepurposesofmembershipintheCourtcouldberegardedasanationalofmorethanonestateshallbedeemedtobeanationaloftheoneinwhichheordinarilyexercisescivilandpoliticalrights.

Article4

1.ThemembersoftheCourtshallbeelectedbytheGeneralAssemblyandbytheSecurityCouncilfromalistofpersonsnominatedbythenationalgroupsinthePermanentCourtofArbitration,inaccordancewiththefollowingprovisions.

2.InthecaseofMembersoftheUnitedNationsnotrepresentedinthePermanentCourtofArbitration,candidatesshallbenominatedbynationalgroupsappointedforthispurposebytheirgovernmentsunderthesameconditionsasthoseprescribedformembersofthePermanentCourtofArbitrationbyArticle44oftheConventionofTheHagueof1907forthepacificsettlementofinternationaldisputes.

3.TheconditionsunderwhichastatewhichisapartytothepresentStatutebutisnotaMemberoftheUnitedNationsmayparticipateinelectingthemembersoftheCourtshall,intheabsenceofaspecialagreement,belaiddownbytheGeneralAssemblyuponrecommendationoftheSecurityCouncil.

Article5

1.Atleastthreemonthsbeforethedateoftheelection,theSecretary-GeneraloftheUnitedNationsshalladdressawrittenrequesttothemembersofthePermanentCourtofArbitrationbelongingtothestateswhicharepartiestothepresentStatute,andtothemembersofthenationalgroupsappointedunderArticle4,paragraph2,invitingthemtoundertake,withinagiventime,bynationalgroups,thenominationofpersonsinapositiontoacceptthedutiesofamemberoftheCourt.

2.Nogroupmaynominatemorethanfourpersons,notmorethantwoofwhomshallbeoftheirownnationality.Innocasemaythenumberofcandidatesnominatedbyagroupbemorethandoublethenumberofseatstobefilled.

Article6

Beforemakingthesenominations,eachnationalgroupisrecommendedtoconsultitshighestcourtofjustice,itslegalfacultiesandschoolsoflaw,anditsnationalacademiesandnationalsectionsofinternationalacademiesdevotedtothestudyoflaw.

Article7

1.TheSecretary-Generalshallpreparealistinalphabeticalorderofallthepersonsthusnominated.SaveasprovidedinArticle12,paragraph2,theseshallbetheonlypersonseligible.

2.TheSecretary-GeneralshallsubmitthislisttotheGeneralAssemblyandtotheSecurityCouncil.

Article8

TheGeneralAssemblyandtheSecurityCouncilshallproceedindependentlyofoneanothertoelectthemembersoftheCourt.

Article9

Ateveryelection,theelectorsshallbearinmindnotonlythatthepersonstobeelectedshouldindividuallypossessthequalificationsrequired,butalsothatinthebodyasawholetherepresentationofthemainformsofcivilizationandoftheprincipallegalsystemsoftheworldshouldbeassured.

Article10

1.ThosecandidateswhoobtainanabsolutemajorityofvotesintheGeneralAssemblyandintheSecurityCouncilshallbeconsideredaselected.

2.AnyvoteoftheSecurityCouncil,whetherfortheelectionofjudgesorfortheappointmentofmembersoftheconferenceenvisagedinArticle12,shallbetakenwithoutanydistinctionbetweenpermanentandnon-permanentmembersoftheSecurityCouncil.

3.IntheeventofmorethanonenationalofthesamestateobtaininganabsolutemajorityofthevotesbothoftheGeneralAssemblyandoftheSecurityCouncil,theeldestoftheseonlyshallbeconsideredaselected.

Article11

If,afterthefirstmeetingheldforthepurposeoftheelection,oneormoreseatsremaintobefilled,asecondand,ifnecessary,athirdmeetingshalltakeplace.

Article12

1.If,afterthethirdmeeting,oneormoreseatsstillremainunfilled,ajointconferenceconsistingofsixmembers,threeappointedbytheGeneralAssemblyandthreebytheSecurityCouncil,maybeformedatanytimeattherequestofeithertheGeneralAssemblyortheSecurityCouncil,forthepurposeofchoosingbythevoteofanabsolutemajorityonenameforeachseatstillvacant,tosubmittotheGeneralAssemblyandtheSecurityCouncilfortheirrespectiveacceptance.

2.Ifthejointconferenceisunanimouslyagreeduponanypersonwhofulfillstherequiredconditions,hemaybeincludedinitslist,eventhoughhewasnotincludedinthelistofnominationsreferredtoinArticle7.

3.Ifthejointconferenceissatisfiedthatitwillnotbesuccessfulinprocuringanelection,thosemembersoftheCourtwhohavealreadybeenelectedshall,withinaperiodtobefixedbytheSecurityCouncil,proceedtofillthevacantseatsbyselectionfromamongthosecandidateswhohaveobtainedvoteseitherintheGeneralAssemblyorintheSecurityCouncil.

4.Intheeventofanequalityofvotesamongthejudges,theeldestjudgeshallhaveacastingvote.

Article13

1.ThemembersoftheCourtshallbeelectedfornineyearsandmaybere-elected;

provided,however,thatofthejudgeselectedatthefirstelection,thetermsoffivejudgesshallexpireattheendofthreeyearsandthetermsoffivemorejudgesshallexpireattheendofsixyears.

2.Thejudgeswhosetermsaretoexpireattheendoftheabove-mentionedinitialperiodsofthreeandsixyearsshallbechosenbylottobedrawnbytheSecretary-Generalimmediatelyafterthefirstelectionhasbeencompleted.

3.ThemembersoftheCourtshallcontinuetodischargetheirdutiesuntiltheirplaceshavebeenfilled.Thoughreplaced,theyshallfinishanycaseswhichtheymayhavebegun.

4.InthecaseoftheresignationofamemberoftheCourt,theresignationshallbeaddressedtothePresidentoftheCourtfortransmissiontotheSecretary-General.Thislastnotificationmakestheplacevacant.

Article14

Vacanciesshallbefilledbythesamemethodasthatlaiddownforthefirstelection,subjecttothefollowingprovision:

theSecretary-Generalshall,withinonemonthoftheoccurrenceofthevacancy,proceedtoissuetheinvitationsprovidedforinArticle5,andthedateoftheelectionshallbefixedbytheSecurityCouncil.

Article15

AmemberoftheCourtelectedtoreplaceamemberwhosetermofofficehasnotexpiredshallholdofficefortheremainderofhispredecessor'

sterm.

Article16

1.NomemberoftheCourtmayexerciseanypoliticaloradministrativefunction,orengageinanyotheroccupationofaprofessionalnature.

2.AnydoubtonthispointshallbesettledbythedecisionoftheCourt.

Article17

1.NomemberoftheCourtmayactasagent,counsel,oradvocateinanycase.

2.Nomembermayparticipateinthedecisionofanycaseinwhichhehaspreviouslytakenpartasagent,counsel,oradvocateforoneoftheparties,orasamemberofanationalorinternationalcourt,orofacommissionofenquiry,orinanyothercapacity.

3.AnydoubtonthispointshallbesettledbythedecisionoftheCourt.

Article18

1.NomemberoftheCourtcanbedismissedunless,intheunanimousopinionoftheothermembers,hehasceasedtofulfilltherequiredconditions.

2.FormalnotificationthereofshallbemadetotheSecretary-GeneralbytheRegistrar.

3.Thisnotificationmakestheplacevacant.

Article19

ThemembersoftheCourt,whenengagedonthebusinessoftheCourt,shallenjoydiplomaticprivilegesandimmunities.

Article20

EverymemberoftheCourtshall,beforetakinguphisduties,makeasolemndeclarationinopencourtthathewillexercisehispowersimpartiallyandconscientiously.

Article21

1.TheCourtshallelectitsPresidentandVice-Presidentforthreeyears;

theymaybere-elected.

2.TheCourtshallappointitsRegistrarandmayprovidefortheappointmentofsuchotherofficersasmaybenecessary.

Article22

1.TheseatoftheCourtshallbeestablishedatTheHague.This,however,shallnotpreventtheCourtfromsittingandexercisingitsfunctionselsewherewhenevertheCourtconsidersitdesirable.
