goodstbbeshipped,infavouroftheSellers,payableattheissuingbankagainsttheSellers’draftatsightaccompaniedbytheshippingdocumentsstipulatedinthecredit.Thebalanceof10%oftheproceedsistobepaidonlyafterthegoodshavebeeninspectedandapprove

yableatsightagainstPresentationofshippingdocumentsinchina,withpartialshipmentsandtransshipmentallowed.ThecoveringLetterofcreditmustreachtheSellers15daysbeforethecontractedmonthofshipment6andremainvalidintheaboveloadingportuntilthe15thdayaftershipment,failingwhichtheSellersreservetherighttocancelthecontractwithoutfurthernoticeandtoclaimagainsttheBuyersforanylossresultingtherefrom.

anyclaimbytheBuyersregardingthecargoshallbesupportedbysu

rveyreportissuedbyasurveyorapprovedbytheSellerandlodgedwithin45daysafterthearrivalofthecargoattheportofdestinaton.TheSellerwillnotconsiderclaimsinrespectofmatterswithinresponsibilityofinsurancecompanyorshippingcompany.

ShouldtheSellerfailtomakedeliveryontime,thebuyershal

lagreetopostponethedeliveryontheconditonthattheSelleragreesofpayapenaltywhichshallbedeductedbythepayingbankatthetimeofpayment.Therateofpenaltyischargedat0.5%ofthetotalvalueofthecargowhosedeliveryhasbeendelayedforeveryweek,odddayslessthanaweekshouldbecountedasaweek.Butthetotalamountofpenaltyshallnotexceed5%ofthetotalvalueofthecargoinvolvedinthelatedelivery.incasetheSellerfailotmakedelivery10weekslaterthanthetimeofshipmentstipulatedonthecontract,theBuyershallhavbetherighttocancelthecontractandtheSellershallstillpaytheaforesaidpenaltytotheBuerwithoutdelay.

Quality/Quantitydiscrepancyandclaim:

incasethequalityand/orquantity/weightarefoundtheBuyersto

benotinconformitywiththecontractafterarrivalofthegoodsattheportofdestination,theBuyersmaylodgeclaimwiththeSellerssupportedbysurveyreportissuedbyaninspectionorganizaitonagreeduponbybothparties,withtheexception,however,ofthoseclaimsforwhichtheinsurancecompanyand/ortheshippingcompanyaretobeheldresponsible.claimforqualitydiscrepancyshouldbefiledbytheBuyerswithin30daysafterarrivalofthegoodsattheportofdestination,whileforquantity/weightdiscrepancyclaimshouldbefiled

bytheBuyerswithin15daysafterarrivalofthegoodsatportofdestination.TheSellersshall,within30daysafterreceiptofthenotificationoftheclaim,aendreplytotheBuyers.
