GeneralProvisions

Article1Thislawisenactedwithaviewtoimprovingregulationofandsupervisionoverthebankingindustry,standardizingsuchregulationandsupervision,preventingandmitigatingrisksinthebankingindustry,protectingthelawfulrightsandinterestsofdepositorsandothercustomers,andpromotingthesounddevelopmentofthebankingindustry.

Article2ThebankingregulatoryauthorityundertheStateCouncilshallberesponsiblefortheregulationofandsupervisionoverthefinancialinstitutionsofthebankingindustryandtheirbusinessoperationsthroughoutthecountry.

Forpurposesofthislaw,the"financialinstitutionsofthebankingindustry"refertothefinancialinstitutionsestablishedinthePeople'sRepublicofChinathatreceivedepositsfromthegeneralpublic,including,amongothers,commercialbanks,urbancreditcooperativesandruralcreditcooperatives,andpolicybanks.

TheprovisionsofthisLawpertainingtotheregulationofandsupervisionoverthefinancialinstitutionsofthebankingindustryareapplicabletotheregulationandsupervisionofthefinancialassetmanagementcompanies,trustandinvestmentcorporations,financecompaniesandfinancialleasingcompaniesestablishedintheterritoryofthePeople'sRepublicofChinaandotherfinancialinstitutionsestablishedwiththeapprovalofthebankingregulatoryauthorityundertheStateCouncil.

ThebankingregulatoryauthorityundertheStateCouncilshall,inaccordancewiththerelevantprovisionsofthisLaw,regulateandsupervisethefinancialinstitutionsthat,uponitsapproval,areestablishedoutsidethePeople'sRepublicofChina,aswellasthebusinessoperationsconductedabroadbythefinancialinstitutionsmentionedintheprecedingtwoparagraphs.

Article3Theobjectivesofregulationofandsupervisionoverthebankingindustryaretopromotethelawful,soundandsteadyoperationofthebankingindustryandpreservepublictrustintheindustry.

Thebankingindustryshallberegulatedandsupervisedinsuchawayastoprotectfaircompetitionintheindustryandincreasethecompetitivenessoftheindustry.

Article4Whenexercisingregulationandsupervision,thebankingregulatoryauthorityshallfollowtheprinciplesoflaw-abidingopenness,impartialityandefficiency.

Article5Performanceofthedutiesofsupervisioninaccordancewithlawbybankingregulatoryauthorityanditsstaffmembersengagedinsupervisionshallbeprotectedbylaw.Localgovernments,governmentdepartmentsatvariouslevels,publicorganizationsandindividualsshallnotinterfere.

Article6ThebankingregulatoryauthorityundertheStateCouncilshallestablishamechanismwiththePeople'sBankofChinaandotherfinancialregulatoryauthoritiesundertheStateCouncilforsharingsupervisoryinformation.

Article7ThebankingregulatoryauthorityundertheStateCouncilmayestablishacooperativemechanismofsupervisionwiththebankingregulatoryauthoritiesinothercountriesorregionsforcross-bordersupervision.

ChapterII

TheRegulatoryAuthority

Article8Inlightoftheneedtoperformitsduties,thebankingregulatoryauthorityundertheStateCouncilmaysetuplocaloffices.Itshallexerciseunifiedleadershipandadministrationofsuchoffices.

ThelocalofficesofthebankingregulatoryauthorityundertheStateCouncilshallperformtheirsupervisorydutieswithinthescopeauthorizedbythesaidauthority.

Article9Thestaffmembersofthebankingregulatoryauthoritywhoareengagedinsupervisionshallhavetheprofessionalknowledgeandworkexperiencecommensuratewiththepositionstheyareholding.

Article10Staffmembersofthebankingregulatoryauthorityshallbedevotedtotheirduties,actinaccordancewithlawandbeimpartialandhonest;theyshallnottakeadvantageoftheirpositionstoseekillegitimatebenefits,orconcurrentlyholdpositionsinenterprisessuchasfinancialinstitutions.

Article11Staffmembersofthebankingregulatoryauthorityshall,inaccordancewithlaw,guardStatesecrets,anditisincumbentuponthemtoguardthesecretsofthefinancialinstitutionsofthebankingindustryandofthepartiessubjecttotheirsupervision.
