________咨询服务有限责任公司为加强我校的外语教学力量,促进英语教学质量的提高,现委托武汉思拓咨询服务有限公司在_____年为我校聘请兼职外教双方达成如下协议:

一、甲方同意聘请担任甲方的______口语教师;

任职期从______年_____月_____日至______年_____月_____日;

每周______课时,每课时_______分钟。

二、课时费为______元/课时,每月_____日按当月课时总量计费支付给乙方。

如果逾期或者欠费,甲方应当按当月应付总费的____%支付违约金,且应付费用并不免除。

外教的往返交通费按外教提供的票据实报实销。

三、甲方对外籍教师进行材料审核或面试后一周内决定是否聘请。

四、开课后的各项内容包括授课时间、课时、授课地点、课时费等应与《兼职外教需求表》一致;

如发生变化,需提前一周通知乙方,否则乙方免责。

五、乙方应当维护甲方和外教的双方利益。

甲方不得私下与乙方提供的外教达成任何不利于乙方的协议,甲方任何变更外教权益和义务的文章来源:

云法律网/docList.htm行为得以乙方认可始为有效。

六、其他未尽事项甲乙双方本着诚信原则协商。

七、本协议书一式两份,复印件有效。

9-17兼职外教聘用合同英文EMPLOYMENTCONTRACTEmployerSchool:

________________________________________I.Employee’sDutiesandResponsibilities1.TheforeignteacherwillinglycomestotheEmployerSchooltobeapart-timeEnglishteacher.TheforeignteachershouldbeanativespeakerofEnglish,havehighereducation,havecertainlanguageteachingexperience,andbeingoodhealth(he/shemustpassthephysicalexaminationatanassignedChinesehospitalafterhe/sheentersChina)andpossessrequireddocuments,suchasTEFLcertificate,foreignexpertcertificate,residencepermit,etc..MaterialssubmittedtotheEmployerSchoolinsupportoftheemployee’sapplicationforthispart-timepositionmustbetrueandnotmisleadinginanysense.2.Theforeignteacherwillcompleteteachingtasksduringthecontractperiod,includingpreparinglessonsandteachingmaterialswellpriortoteaching,conductinglessonsandaccessingstudents’work.Besides,theforeignteacherwillgivelessonsontimeinaccordancewiththeclasstimerequiredbytheschool.3.TheforeignteacherwillusestrictlytheteachingmaterialsandtheteachingplanprovidedbytheEmployerSchool,conscientiouslyaccomplishingtheteachingplan,toassurehighqualityteaching.TheforeignteachermustkeepallinformationregardingtotheEmployerSchool’steachingmethodsandadministrationconfidentialandnotusetheteachingmethodsandmaterialsforanyotherpurpose.4.Duringtherequiredlecturetime,iftheforeignteacherleavesShenzhenhe/sheshouldinformtheCoordinator.WhentravelingoutsideofGuangdongprovince,HongKong,orMacao,theforeignteacherisfurtherresponsibleforannouncinghis/hertravelplanstotheEmployerSchoolthroughhis/hercontactteacherandtheCoordinator,aweekinadvanceinwritingorviae-mail.5.Intheeventofillnessthatpreventstheforeignteacherfromteaching,he/sheisresponsibletonotifybothhis/hercontactteacherandtheCoordinatorinadvance,andfurtherisrequiredtoprovidetheEmployerSchoolwithwrittendocumentation.Ifthisnotificationisnotdone,therewillbeareductionofpaybyRMB100pertimeofabsence;

thispenaltyalsoappliestoanyunapprovedtardinessfromclass.(Forinstance,iftheforeignteacherislateforoveronehour,heorshewillloseRMB300:

wageRMB200addedafineofRMB100).Afterreceivingthewrittenwarningletterfromtheemployer,atotalofthreesuchoccurrencesaregroundsfordismissal.6.Duringthelessons,theforeignteacherwillmakehisorherownmealandtransportationarrangements.7.TheforeignteacheristorespectthemoralstandardsandcustomsoftheChinesepeople.Thisspecificallyincludesmaintaininganappropriateprofessionalappearanceandstandardofbehavior.TheforeignteachermustnotharmtheimageoftheEmployerSchoolorotherstaffwiththeEmployerSchool.8.TheforeignteacherwillfollowtheEmployerSchool’sworkingregulationsandtherelevantForeignExpertregulationsoftheChinesegovernment.9.TheforeignteacheristofollowChineselawandregulations,andnotinterfereinChineseinternalaffairs.II.EmployerSchool’sResponsibilities1.Theforeignteacher’semploymentperiodisfromsigningdateto________.Teachingdutiesstartfrom______andendby_______.TheEmployerSchoolwillprovideawageofRMB200/hourtotheforeignteacherduringtheemploymentperiod.Thewageshouldbepaidbymonthandtheforeignteacher’sremunerationwillbecalculatedaccordingtohis/heractualteachinghours.Ifthereisanyfine,theteacherwillbeinformedinadvance.The12thofeachmonthispaydayandtheforeignteacherwillreceivelastmonth’swageincash.2.TheEmployerSchoolwillprovideintroductoryinstructiononrelevantworkingregulationsoftheEmployerSchool’ssideandChinesegovernmentregulationsonforeignexperts.3.TheEmployerSchoolwillguide,check,andevaluatetheforeignteacher’swork.4.TheEmployerSchoolwillnotetheforeignteacheroneweekaheadifthereisanychangeupontheagreedteachingscheduleorclasstime.5.TheEmployerSchoolwillarrangeabi-lingualco-workerorassistant,referredtoasthe“contactteacher”,toassisttheforeignteacherattheschool,especiallyforinfants’orjuniorprimaryschoolforeignteachers.III.Modification,Dissolutionand/orTerminationoftheContract1.Bothsidesmustabidebythecontract.Neithersidecanmodify,dissolve,orterminatethecontract,exceptasspecifiedbelow.2.WiththeagreementoftheEmployerSchool,theforeignteacher,thecontractcanbemodified,dissolved,orterminated.Untilreachingsuchanagreement,allsidesshouldstrictlycarryoutthecontract.3.TheEmployerSchoolhastheright,withwrittennotificationtotheforeignteacher,toterminatetheemploymentcontractandstopallbenefitsandpaymentstoaforeignteacherunderthefollowingconditions:

(a.)Iftheforeignteacherreceivesfifteen(15)dayswrittennoticefromtheEmployerSchoolortheCoordinatorspecifyinghis/herfailuretocomplywiththetermsofthecontract,andfailstocorrectthenoncompliance;

or(b.)When,inthejudgmentofaqualifiedmedicaldoctor,theforeignteacherisunabletoresumehis/herdutiesandresponsibilitiesaftertheexpirationofthirty(30)continuousdaysofsickleave.(c.)Duringthecontractperiod,theforeignteachershallbecarefulnottomakeimproperstatementsthatviolatethepoliticalsafetyofthecountryandChineselawsandresultinadverseeffects.Otherwisetheemployerschoolhastherighttoterminatetheemploymentcontractandrelevantresponsibilitiesshallbeinvestigatedaccordingtolaws.4.Theforeignteacherhastheright,withwrittennotificationtotheEmployerSchooltoterminatethecontractwithoutfurtherobligationtotheEmployerSchoolunderthefollowingconditions:

(a.)If,afterthirty(30)dayswrittennoticefromtheforeignteachertotheEmployerSchoolandtheCoordinator,theEmployerSchoolfailstoprovidetheworkingandlivingconditionspromisedinthecontract;

or(b.)IftheEmployerSchooldoesnotpayinatimelymannertheforeignteacher’ssalary,andfailstocorrecttheproblemafterten(10)dayswrittennotificationfromtheforeignteachertotheSchoolandtheCoordinator;

or(c.)Iftheforeignteacherseekstoterminatetheemploymentcontractduetoaserioushealthand/ormedicalcondition,andtheforeignteacherprovidesappropriatedocumentationfromaqualifiedmedicaldoctor,andtheEmployerSchoolagreestosuchterminationformedicalreasons.IftheEmployerSchooldoesnotagreetotheterminationformedicalreasons,thepenaltyprovisionofSectionIVofthecontractwillapply.III.DisagreementandAttributionThiscontractisbasedonChineselaw,andifthereisdisagreement,arbitrationwillbeheldattheEmployerSchool&

slocalcourt.V.ContractCopies,ArbitrationLocation,andEffectivePeriodThiscontracthastwocopies;

eachcopywillbeinbothChineseandEnglish.Copiesinbothlanguageshavethesameeffect,butbecausetheEnglishversionisbasedontheChineseversion,ifthetwoversions(EnglishandChinese)donotmatch,theChineseversionwillbetheonetobefollowed.ThiscontractwillbeeffectiveuponsigningbybothsidesofbothitsEnglishandChineseversions.Thiscontractwillexpireon___________Note:
