Chapter1
Article1
ThisLawisformulatedtoimprovethelaborcontractsystem,tospecifytherightsandobligationsofthepartiestolaborcontracts,toprotectthelegitimaterightsandinterestsofworkers,andtobuildanddevelopharmoniousandstableemploymentrelationships.
Article2
ThisLawappliestotheestablishmentoflaborrelationshipsbetween,theconclusionof,performanceof,amendmentof,revocationofandterminationof,laborcontractsbyworkersandorganizationssuchasenterprises,individualeconomicorganizationsandprivatenon-enterpriseunitsinthePeople’sRepublicofChina(“Employers”).
Theconclusion,performance,amendment,revocationandterminationoflaborcontractsbetweenstateauthorities,institutionsorsocialorganizationsandworkerswithwhomtheyestablishemploymentrelationships,shallbesubjecttothislaw.
Article3
Theconclusionofalaborcontractshallbebasedontheprinciplesoflawfulness,fairness,equality,voluntariness,negotiatedconsensusandgoodfaith.Alawfullyconcludedlaborcontractshallhavebindingforce,boththeEmployerandtheemployeeshallperformtheirrespectiveobligationsstipulatedtherein.
Article4
Employersshallformulateandimprovelaborrulesandregulationsinaccordancewiththelaw,soastoensurethatemployeesenjoytheirlaborrightsandperformtheirlaborobligations.
Theformulations,amendmentsanddecisionsmadebyEmployerswithrespecttorulesonlaborcompensation,workinghours,leaveandrest,occupationalsafetyandhygiene,insuranceandwelfare,training,workdisciplineorworkquotamanagement,etc.,whichhaveadirectimpactonemployees’immediaterightsandinterests,orothermaterialmatters,shallbepresentedtoanddiscussedwiththeemployeerepresentativecongressoralltheemployees,andtheproposalandadvicethereofshallbedeterminedafterconsultationwiththelaborunionoremployeerepresentativeonthebasisofequality.
If,duringtheimplementationofaruleorregulationordecisiononamaterialmatter,thelaborunionoranyoftheemployeesdeemsitinappropriate,theyshallbeentitledtoraisetheissuewiththeEmployerandhaveitamendedafterconsultation.
TheEmployershallmakerules,regulationsanddecisionsonmaterialmattersthathaveadirectimpactonemployees’immediateinterestsandrights,publicorcommunicatethesametotheemployees.
Article5
ThelaboradministrationauthoritiesofthePeople’sGovernmentsatthecountylevelandaboveshall,togetherwithlaborunionsandenterpriserepresentatives,establishacomprehensivetri-partitemechanismfortheco-ordinationofemploymentrelationships,inordertojointlystudyandresolvematerialissuesrelatingtoemploymentrelationships.
Article6
ThelaborunionshallassistandguideworkersintheconclusionandperformanceoflaborcontractswiththeirEmployer,andestablishacollectiveconsultationmechanismwiththeEmployerinordertoprotectthelawfulrightsandinterestsofworkers.
ChapterII
Article7
TheemploymentrelationshipbetweenanEmployerandanemployeeshallcommenceonthedatetheemployeecommenceswork.TheEmployershallkeeparegisterofemployees,forfuturereference.
Article8
TheEmployershalltruthfullyadvisetheemployeeofthescopeofwork,theworkingconditions,theplaceofwork,occupationalhazards,productionsafetyconditions,laborcompensationandothermattersrequestedbytheemployee;
theEmployershallbeentitledtotheworkerbasicinformationoftheemployeethatdirectlyrelatestothelaborcontract,andtheemployeeshalltruthfullyprovidethesame.
Article9
Whenhiringanemployee,theEmployershallnotretaintheemployee’sresidentIDcardorotherdocumentation,nordemandtheemployeetoprovidesecurityorcollectpropertyfromhim/herundersomeotherguise.
Article10
Awrittenlaborcontractshallbeconcludedwhenestablishinganemploymentrelationship.
Whereanemploymentrelationshiphasbeenestablishedwithouttheconclusionofawrittenlaborcontract,thewrittenlaborcontractshallbeconcludedwithinone
(1)monthfromthedatetheemployeecommenceswork.
WhereanEmployerandanemployeeconcludealaborcontractbeforetheemployeecommenceswork,theemploymentrelationshipshallbeestablishedonthedatetheemployeecommenceswork.
Article11
WhereanEmployerfailstoconcludeawrittenlaborcontractwithanemployeebeforetheemployeecommenceswork,anditisunclearwhatlaborcompensationwasagreeduponwiththeemployee,thelaborcompensationforthenewlyrecruitedemployeeshallbepaidinaccordancewiththestandardsstipulatedinthecollectivecontract;
wherethereisnocollectivecontractorthecollectivecontractissilentonthematter,theprincipleofequalpayforequalworkshallapply.
Article12
Laborcontractsaredividedintofixed-termlaborcontracts,open-endedlaborcontractsandlaborcontractsthatterminateuponthecompletionofacertaintask.
Article13
A‘fixed-termlaborcontract’referstoalaborcontractwheretheterminationdatehasbeenagreeduponbytheEmployerandtheemployee.
Afixed-termlaborcontractmaybeconcludedbetweenanEmployerandanemployeeuponconsultation.
Article14
An‘open-endedlaborcontract’referstoalaborcontractwheretheEmployerandtheemployeehaveagreednottostipulateadefiniteterminationdate.
Anopen-endedlaborcontractmaybeconcludedbetweenanEmployerandanemployeeuponconsultation.Ifanemployeeproposesoragreestorenewandconcludealaborcontractinanyofthefollowingcircumstances,anopen-endedlaborcontractshallbeconcluded,unlesstheemployeerequeststheconclusionofafixed-termlaborcontractinstead:
(1)
TheemployeehasbeenworkingfortheEmployerforten(10)consecutiveyears;
(2)
WhentheEmployerfirstintroducesthelaborcontractsystemorthestate-ownedenterprisethatemployshimre-concludesitslaborcontractsasofrestructuring,theemployeehasbeenworkingfortheEmployerforten(10)consecutiveyearsandislessthan10yearsawayfromhislegalretirementage;
or
(3)
Wherealaborcontractwasconcludedasafixed-termlaborcontractontwoconsecutiveoccasionsandtheemployee,intheabsenceofanyofthecircumstancesstipulatedinArticle39anditems
(1)and
(2)ofArticle40ofthislaw,renewssuchcontract.
IfanEmployerfailstoconcludeawrittenlaborcontractwithanemployeewithinone
(1)yearfromthedatetheemployeecommenceswork,theyshallbedeemedtohaveenteredintoanopen-endedlaborcontract.
Article15
A‘laborcontractthatterminatesuponthecompletionofacertaintask’referstoalaborcontractwheretheEmployerandtheemployeehaveagreedthatthecontractualtermisbasedonthecompletionofaspecifictask.
AnEmployerandanemployeemay,uponconsultation,concludealaborcontractwithatermthatisbasedonthecompletionofacertaintask.
Article16
AlaborcontractshallbecomeeffectiveaftertheEmployerandtheemployeehavebothsignedorsealedsuchcontractuponreachinganegotiatedconsensus.
TheEmployerandtheemployeeshalleachkeeponecopyoftheemploymentagreement.
Article17
Alaborcontractshallincludethefollowingitems:
name,domicileandlegalrepresentativeormainpersonin-chargeoftheEmployer;
name,residentialaddressandnumberoftheresidentIDcardorothervalididentitydocumentnumberoftheworker;
termofthelaborcontract;
(4)
scopeofworkandplaceofwork;
(5)
workinghours,restandleave;
(6)
laborcompensation;
(7)
socialinsurance;
(8)
laborprotection,workingconditionsandprotectionagainstoccupationalhazards;
and
(9)
otherissuesrequiredbylawsandregulationstobeincludedinthelaborcontract.
Apartfromthemandatorytermsmentionedabove,anEmployerandanemployeemayagreetoincludeothermattersinthelaborcontractsuchasprobationperiod,training,confidentiality,supplementaryinsuranceandwelfare,etc.
Article18
Shouldadisputeariseduetotheambiguousnatureofthestandardsforlaborcompensationorworkingconditionsorothermatters,theEmployerandemployeemayrenegotiate;
ifsuchnegotiationfails,theprovisionsofthecollectivecontractshallapply.Ifthereisnocollectivecontractorifthecollectivecontractissilentontheissueoflaborcompensation,theprincipleofequalpayforequalworkshallapply;
ifthereisnocollectivecontractorthecollectivecontractissilentonthestandardsforworkingconditionsorothermatters,therelevantregulationsoftheStateshallapply.
