房屋租赁合同

根据《中华人民共和国合同法》、《上海市房屋租赁条例》（以下简称：

《条例》）的规定，甲、乙双方在平等、自愿、公平和诚实信用的基础上，经协商一致，就乙方承租甲方可依法出租的房屋事宜，订立本合同。

1.租赁物业GRANTOFTENANCY

1.1 甲方同意出租坐落在本市：

2.租赁期限TERM

2.2 乙方对该物业有优先续租权，但须于本合同自然终止日前一个月书面通知甲方。

2.3甲方有责任保证乙方为唯一的房屋使用者。

乙方在没有得到甲方书面许可的情况下，无权以任何理由将物业转租给任何第三者。

该物业的房屋性质为住宅用房，乙方不可用作其它用途。

PartyAshallberesponsibleforensuringPartyB'sprivilegeforusingthePropertyexclusively.PartyBshallnotbeallowedtosub-letthePropertytoanythirdpartiesforanyreasonwithoutobtainingwrittenpermissionfromPartyA.ThePropertyisforresidentialuseonly.PartyBshallnotusethePropertyforanyotherpurposes.

3.保证金SECURITYDEPOSIT

3.1乙方应支付给甲方RMB￥元（）作为房租、家具家电和一切设备的保证金以保证在整个租赁期限完全遵守条款中的义务。

在整个租赁期限内，甲方将无息保留保证金。

当乙方不履行本合同条款时，甲方有权根据第9.2条，没收保证金。

该保证金不可视为预付的租金。

PartyBshallpayPartyAtwomonthsrentRMB￥assecuritydepositforrental,furnitureandappliances,andallequipmentsinsideforthefullperformanceofitsobligationsduringthewholeleaseterm.ThedepositshallberetainedbyPartyAthroughoutthetermofthisLeasewithoutinterest,withpowertoPartyAtoforfeitthedepositaccordingtoclause9.2hereof,intheeventofanynon-performanceornon-observanceofthisContractbyPartyB.Itisexpresslyacknowledgedthatthedepositshallnotbeusedasadvancerentalpayment.

3.2在合同终止时，在乙方提出书面通知后及乙方将该物业以良好状态（合理磨损、因潜在或结构上的缺陷所造成的损坏、因甲方没有完全履行其对该物业的保养和维修责任所造成的损坏除外）交付给甲方后并在乙方结清所有费用后十个工作日内，甲方应将保证金无息归还乙方。

若有任何由乙方造成的损坏（自然损坏、因潜在或结构上的缺陷所造成的损坏、因甲方没有完全履行其对该物业的保养和维修责任所造成的损坏除外），甲方将从保证金中扣除合理赔偿后，其余部分将由甲方归还给乙方。

如甲方逾期归还保证金，甲方须支付乙方每日0.3%保证金的滞纳金。

AttheexpiryofthisLease,afterPartyB’swrittennoticetoPartyAforleasetermination,anduponthedeliveryofthePropertytoPartyAingoodcondition（fairwearandtear,damagecausedbyinherentorstructuraldefectsoftheProperty,damageresultedfromPartyA'sfailuretomaintainandrepairthePropertyexcepted）,PartyAshallrefundthedeposittoPartyB（withoutinterest）withinTen（10）workingdaysafterPartyBsettledallpaymentsunderthisLease.IfthereisanylossordamagetothePropertywhichiscausedbydefaultofPartyB（fairwearandtear,damagecausedbyinherentorstructuredefectsoftheProperty,damageresultedfromPartyA’sfailuretomaintainandrepairthePropertyexcepted）,PartyAmaydeductareasonableamountfromthedepositascompensationandrefundthebalancethereoftoPartyB.IntheeventofanylaterefundingoftheDeposit,PartyAshallpayaliquidateddamageattherateof0.3%oftheDepositpereachdayofdelaytoPartyB.
