第一章总则
第一条为控制和消除职业危害，防治职业病，保护职工身体健康，促进生产发展，根据国家有关法律法规，结合我省实际情况，制定本条例。
第二条在本省境内从事有职业危害的各类企业和个体经济组织（以下简称企业）必须遵守本条例。
第三条职业病防治工作实行预防为主的方针，防治结合，综合治理。
第四条各级人民政府领导职业病防治工作，制定职业病防治规划，并组织实施。
各级卫生行政部门对职业病防治工作实施统一监督管理。
第五条政府鼓励发展职业卫生科学研究，推广职业病防治先进技术，普及职业病防治知识。
对在职业病防治工作中取得显著成绩的单位和个人，由人民政府给予表彰奖励。
第二章管理与监督
第六条企业法定代表人，对本企业的职业病防治工作负有直接责任，必须建立健全职业卫生管理制度，采取有效措施使本企业有职业危害的场所达到国家卫生标准。
企业必须对从事有职业危害作业的职工进行职业卫生培训和职业性健康体检，未经职业卫生培训和体检的不得安排上岗作业。

第七条县级以上人民政府行业管理部门或企业行政主管部门，对本行业或所属企业的职业病防治工作行使下列管理职责:
（一）制定本行业或所属企业职业病防治规划并组织实施;
（二）检查本行业或所属企业执行国家有关防治职业病的法律、法规、规章和标准的情况;
（三）组织职业卫生教育、培训工作;
（四）组织调查处理重大急性职业病事故;
（五）执行法律、法规规定的其他职业卫生管理职责。
第八条县级以上卫生行政部门对职业病防治工作行使下列监督职权:
（一）对企业有职业危害的作业场所是否符合国家卫生标准和要求进行监督检查;
（二）参加企业基建、技改项目竣工卫生评价验收;
（三）对职业卫生监测和职业性健康检查制度的执行情况进行监督检查;
（四）对国家规定的职业卫生报告制度的执行情况进行监督检查;
（五）对重大急性职业病事故组织卫生学调查并参与事故的处理;
（六）进行职业卫生状况的调查与取证;
（七）对违反本条例的行为依法实施行政处罚;
（八）法律、法规、规章规定的其他监督职权。
县级以上劳动行政部门对有关劳动卫生工程技术依法实行国家监察。
第九条工会组织依法对企业的职业卫生工作进行监督，对企业存在严重职业危害和损害职业病患者合法权益，有权提出处理意见，企业应及时妥善处理。
第十条省卫生行政部门依法建立职业卫生监督管理制度，制定国家尚未制定本省又需要的作业场所卫生标准、职业病诊断标准和有关技术规范。
第十一条县级以上卫生行政部门设职业病防治监督员，依法行使监督职权。
职业病防治监督员由专业人员担任，由省级卫生行政部门任命并发给证件。
第十二条职业病防治监督员在执行任务时，有权进入现场、调查取证、调阅有关材料，企业不得拒绝或者隐匿。
职业病防治监督员和卫生监督部门对涉及企业秘密的资料，有保密的义务。
