SUMMARY:
TheU.S.TradeRepresentative(TradeRepresentative)hasdeterminedthattheacts,policies,andpracticesoftheGovernmentofChinarelatedtotechnologytransfer,intellectualproperty,andinnovationcoveredintheinvestigationareunreasonableordiscriminatoryandburdenorrestrictU.S.commerce.TheOfficeofthe
U.S.TradeRepresentative(USTR)isseekingpubliccommentandwillholdapublichearingregardingaproposeddeterminationonappropriateactioninresponsetotheseacts,policies,andpractices.TheTradeRepresentativeproposesanadditionaldutyof25percentonalistofproductsfromChina.Thelistofproducts,definedby8-digitsubheadingsoftheHarmonizedTariffScheduleoftheUnitedStates(HTSUS),issetoutintheAnnextothisNotice.

OnAugust14,2017,thePresidentissuedaMemorandum(82FR39007)instructingtheTradeRepresentativetodeterminewhethertoinvestigateundersection301oftheTradeActof1974(TradeAct)(19U.S.C.2411),laws,policies,practices,or
actionsoftheGovernmentofChinathatmaybeunreasonableordiscriminatoryandthatmaybeharmingAmericanintellectualpropertyrights,innovation,ortechnologydevelopment.
OnAugust18,2017,afterconsultationwiththeappropriateadvisorycommitteesandtheinter-agencySection301Committee,USTRinitiatedaninvestigationintocertainacts,policies,andpracticesoftheGovernmentofChinarelatedtotechnologytransfer,intellectualproperty,andinnovation.Thenoticeofinitiation(82FR40213)solicitedwrittencommentson,interalia,fourcategoriesofacts,policiesandpracticesoftheGovernmentofChina:
1.TheChinesegovernmentreportedlyusesavarietyoftools,includingopaqueanddiscretionaryadministrativeapprovalprocesses,jointventurerequirements,foreignequitylimitations,procurements,andothermechanismstoregulateorintervenein
U.S.companies'
operationsinChina,inordertorequireorpressurethetransferoftechnologiesandintellectualpropertytoChinesecompanies.Moreover,manyU.S.companiesreportfacingvagueandunwrittenrules,aswellaslocalrulesthatdivergefromnationalones,whichareappliedinaselectiveandnon-transparentmannerbyChinesegovernmentofficialstopressuretechnologytransfer.

sacts,policiesandpracticesreportedlydepriveU.S.companiesoftheabilitytosetmarket-basedtermsinlicensingandothertechnology-relatednegotiationswithChinesecompaniesandundermineU.S.companies'
controlovertheirtechnologyinChina.Forexample,theRegulationsonTechnologyImportandExportAdministrationmandateparticulartermsforindemnitiesandownershipof
technologyimprovementsforimportedtechnology,andothermeasuresalsoimposenon-markettermsinlicensingandtechnologycontracts.
3.TheChinesegovernmentreportedlydirectsand/orunfairlyfacilitatesthesystematicinvestmentin,and/oracquisitionof,U.S.companiesandassetsbyChinesecompaniestoobtaincutting-edgetechnologiesandintellectualpropertyandgeneratelarge-scaletechnologytransfer
