RegulationsofthePeople’sRepublicofChinaonImplementingCustomsAdministrativePenalty

（Adoptedatthe62ndExecutiveMeetingoftheStateCouncilonSeptember1,2004,promulgatedbyDecreeNo.420oftheStateCouncilofthePeople’sRepublicofChinaonSeptember19,2004,andeffectiveasofNovember1,2004）

ChapterIGeneralProvisions

Article1TheseimplementingRegulationsareformulatedinaccordancewiththeprovisionsoftheCustomsLawofthePeople’sRepublicofChina（hereinafterreferredtoastheCustomsLaw）andotherrelatedlawsforthepurposesofstandardizingCustomsadministrativepenalty,safeguardingthelawfulexercisebytheCustomsofitsfunctionsandpowersandprotectingthelawfulrightsandinterestsofcitizens,legalpersonsandotherorganizations.

Article2TheseimplementingRegulationsshallbeapplicabletothedispositionofthesmugglingactswhicharenotinvestigatedforcriminalliabilityinaccordancewiththelaw,theactswhichviolateregulationsonCustomscontrol,aswellastheactsforwhichadministrativepenaltyisimposedbytheCustomsasprescribedbylawsandadministrativeregulations.

Article3CustomsadministrativepenaltyshallbeunderthejurisdictionoftheCustomsofficediscoveringtheillegalact,andmayalsobeunderthejurisdictionoftheCustomsofficeintheplacewheretheillegalactiscommitted.

WheretwoormoreCustomsofficeshavejurisdictionoveracase,theCustomsofficewhichfirstdiscoverstheillegalactshallhavejurisdiction.

Wherejurisdictionoveracaseisnotclear,theCustomsofficesconcernedshallmakeadeterminationthereonthroughconsultation.Ifconsultationfails,theyshallreportthemattertotheircommonsuperiorCustomsofficeforthedesignationofjurisdiction.

Foragraveandcomplicatedcase,theGeneralAdministrationofCustomsmaydesignateaCustomsofficetoexercisejurisdiction.

Article4Ondiscoveringanillegalactwhichshallbedealtwithbyanotheradministrativedepartmentinaccordancewiththelaw,aCustomsofficeshallreferthecasetotherelevantadministrativedepartmentfordisposition;wheretheillegalactissuspectedofinvolvingacrime,thecaseshallbereferredtotheCustomspolicedepartmentresponsiblefortheinvestigationofsmugglingcrimesorthelocalpublicsecurityorganfordispositionaccordingtolaw.

Article5WheresuchanadministrativepenaltyasawarningorafineisimposedinaccordancewiththeseimplementingRegulationsbutnoinwardoroutwardgoods,articlesormeansoftransportareconfiscatedsubsequently,thepartyconcernedshallnotbeexemptedfromtheobligationstopayCustomsduties,submittheimportorexportlicensingdocumentsorcompleterelevantCustomsformalitiesasspecifiedbythelaw.

Article6WhereanyoneresistsorobstructstheCustomspolicedepartmentresponsiblefortheinvestigationofsmugglingcrimesfromcarryingoutitsdutyaccordingtolaw,theCustomspolicedepartmentresponsiblefortheinvestigationofsmugglingcrimessetupinaregionalCustomsofficeorsubordinateCustomsofficeshallimposepenaltyinaccordancewiththerelevantprovisionsonadministrativepenaltiesforpublicsecurity.

WhereanyoneresistsorobstructsotherCustomsofficersfromcarryingouttheirdutyaccordingtolaw,thecaseshallbereportedtothelocalpublicsecurityorganfordispositionaccordingtolaw.

ChapterIISmugglingActsandthePenalties

Article7Underanyofthefollowingcircumstances,anyonewho,inviolationoftheCustomsLaw,otherrelevantlawsoradministrativeregulations,evadesCustomscontrol,dutiespayable,orprohibitiveorrestrictiveentryorexitadministrationoftheStateiscommittingsmuggling:

（1）withoutapprovaloftheStateCouncilorthedepartmentempoweredbytheStateCouncil,totransportorcarrygoodsorarticlestheentryorexitofwhichisprohibitedorrestrictedbytheStateorgoodsorarticlesforwhichdutiesarepayableaccordingtolawintooroutoftheterritoryataplacewherethereisnoCustomsoffice;

（2）byconcealment,disguise,incompleteorfraudulentdeclarationorothermeansaimingatevadingCustomscontrol,totransport,carryormailgoodsorarticlestheentryorexitofwhichisprohibitedorrestrictedbytheStateorgoodsorarticlesforwhichdutiesarepayableaccordingtolawintooroutoftheterritoryataplacewherethereisaCustomsoffice;

（3）tosellwithintheterritorygoods,articlesorinwardforeignmeansoftransportunderCustomscontrolbyusinganycounterfeitedoradulteratedhandbook,documents,seal,accountbook,electronicdataorothermeansofevadingCustomscontrol;

（4）toletgoodsorarticleswhichshouldbeunderCustomscontrolgetoutofsuchcontrolbyusinganycounterfeitedoradulteratedhandbook,documents,seal,accountbookorelectronicdataorbymeansoffraudulentdeclarationonthematerialconsumptionperfinishedproductforprocessingtrade;

（5）totransportgoodsorarticleswhichshouldbeunderCustomscontrolinabondedarea,exportprocessingareaorotherspecialCustomscontrollingareaoutofsuchanarea,byconcealment,disguise,incompleteorfraudulentdeclarationorothermeansofevadingCustomscontrol;or

（6）tocommitotheractsofevadingCustomscontrolthatconstitutesmuggling.

Article8Anyofthefollowingactsshallbedealtwithassmuggling:

（1）topurchasethegoodsorarticlesdirectlyandillegallyfromthesmugglerswhileknowingwellthatthegoodsorarticlesareimportedbysmuggling;or

（2）foranyvesselsorpersonsaboard,withoutlawfuldocuments,totransport,purchaseorsellgoodsorarticlestheentryorexitofwhichisprohibitedorrestrictedbytheState,ortotransport,purchaseorsellgoodsforwhichdutiesshouldbepaidaccordingtolaw,oninlandseas,territorialwaters,boundaryriversorboundarylakes.

Article9AnyonewhocommitsanyoftheactslistedinArticles7and8oftheseimplementingRegulationsshallbepunishedinaccordancewiththefollowingprovisions:

（1）whereanyonesmugglesgoodstheimportationorexportationofwhichisprohibitedbytheState,theCustomsshallconfiscatethesmuggledgoodsandillegalgainsandmay,inaddition,imposeafineofnotmorethan1,000,000yuan;whereanyonesmugglesarticlestheentryorexitofwhichisprohibitedbytheState,theCustomsshallconfiscatethesmuggledarticlesandillegalgainsandmay,inaddition,imposeafineofnotmorethan100,000yuan;

（2）whereanyonesmugglesgoodsorarticlestheentryorexitofwhichisrestrictedbytheStatebyfailingtosubmitthelicensingdocumentsasrequired,buthehasnotevadeddutiespayable,theCustomsshallconfiscatethesmuggledgoodsorarticlesandillegalgainsandmay,inaddition,imposeafinenotexceedingthevalueofthesmuggledgoodsorarticles;or

（3）whereanyonesmugglesgoodsorarticlesforwhichdutiesshouldbepaidaccordingtolawbyevadingdutiespayable,buthehasnotevadedlicensingadministration,theCustomsshallconfiscatethesmuggledgoodsorarticlesandillegalgainsandmay,inaddition,imposeafineofnotmorethanthreetimestheamountofdutiespayablebutevaded.

Meansoftransportspeciallyusedforsmugglingorgoodsorarticlesspeciallyusedforshieldingsmuggling,aswellasmeansoftransportusedforsmugglingorgoodsorarticlesusedforshieldingsmugglingthreetimesormoreintwoyearsshallbeconfiscated.Equipment,interlayersandhiddenlayersspeciallymadeforconcealingsmuggledgoodsorarticlesshallbeconfiscatedordemolished.Anyonewhousessuchspeciallymadeequipment,interlayersorhiddenlayersinsmugglingshallbegivenaheavierpenalty.

Article10Anyonewhoconspireswithsmugglersandprovidesthemwithloans,funds,accountnumbers,invoices,certificatesorCustomsdocuments,orconspireswithsmugglersandprovidesthemwithsuchconveniencesaspickingup,forwarding,transporting,storingandmailingsmuggledgoodsorarticlesorotherconveniencesshallbedealtwithasaco-partyofthesmugglers.Theillegalgainsobtainedtherefromshallbeconfiscated,andapenaltyshallbeimposedaccordingtotheprovisionsofArticle9oftheseimplementingRegulations.

Article11WhereaCustomsclearingenterpriseorindividual,oranenterprisepermittedbytheCustomstoengageinsuchbusinessesastransportation,storage,processing,assembling,consignmentsaleandexhibitionofthegoodsunderCustomscontrolhascommittedacrimeofsmugglingorcommittedsmugglingtwiceormoreinoneyear,theCustomsmayrevokeitsregistrationorhisqualificationsfordeclaration.

ChapterIIIActsViolatingRegulationsonCustomsControlandthePenalties

Article12ActswhichviolatetheCustomsLaworotherrelatedlaws,administrativeregulationsorrulesbutdonotconstituteactsofsmugglingshallbeactsviolatingregulationsonCustomscontrol.

Article13Anyonewho,inviolationoftheprovisionsoftheStateonimportandexportadministration,importsorexportsgoodstheimportationorexportationofwhichisprohibitedbytheStateshallbeorderedtotakethegoodsoutoftheterritoryandshallbefinednotmorethan1,000,000yuan.

Article14Whereanyone,inviolationoftheprovisionsoftheStateonimportandexportadministration,importsorexportsgoodstheimportationorexportationofwhichisrestrictedbytheState,andtheconsigneeofimportgoodsortheconsignerofexportgoodscannotsubmitthelicensingdocumentswhenmakingthedeclarationtotheCustoms,suchimportorexportgoodsshallnotbereleasedandafineofnotmorethan30%ofthevalueofthegoodsshallbeimposed.
