　　IMPLEMENTINGREGULATIONS

　　OFTHEPATENTLAWOFTHEPEOPLESREPUBLICOFCHINA

　　（PromulgatedbyDecreeNo.306oftheStateCouncilofthePeoplesRepublicofChinaonJune15,2001,amendedthefirsttimeonDecember28,2002accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeoplesRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeoplesRepublicofChina）

　　ChapterIGeneralProvisions

　　Rule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeoplesRepublicofChina（hereinafterreferredtoasthePatentLaw）.

　　Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.

　　Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtechnicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.

　　WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.

　　Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobethedateoffiling;wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,thedateonwhichthepatentadministrationdepartmentundertheStateCouncilreceivesthedocumentshallbethedateoffiling,exceptwherethedateofmailingisprovedbythepartyconcerned.

　　AnydocumentofthepatentadministrationdepartmentundertheStateCouncilmaybeservedbymail,bypersonaldeliveryorbyotherforms.Whereanypartyconcernedappointsapatentagency,thedocumentshallbesenttothepatentagency;wherenopatentagencyisappointed,thedocumentshallbesenttothecontactingpersonnamedintherequest.

　　WhereanydocumentissentbymailbythepatentadministrationdepartmentundertheStateCouncil,the16thdayfromthedateofmailingshallbepresumedtobethedateonwhichthepartyconcernedreceivesthedocument.

　　Whereanydocumentisdeliveredpersonallyinaccordancewiththeprovisionsofthepatentadministration

　　departmentundertheStateCouncil,thedateofdeliveryisthedateonwhichthepartyconcernedreceivesthedocument.

　　Wheretheaddressofanydocumentisnotclearanditcannotbesentbymail,thedocumentmaybeservedbymakinganannouncement.Attheexpirationofonemonthfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.

　　Rule5.ThefirstdayofanytimelimitprescribedinthePatentLawandtheseImplementingRegulationsshallnotbecountedinthetimelimit.Wherethetimelimitiscountedbyyearorbymonth,itshallexpireonthecorrespondingdayofthelastmonth;ifthereisnocorrespondingdayinthatmonth,thetimelimitshallexpireonthelastdayofthatmonth;ifatimelimitexpiresonanofficialholiday,itshallexpireonthefirstworkingdayfollowingthatofficialholiday.

　　Rule6.WhereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofforcemajeure,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateonwhichtheimpedimentisremoved,atthelatestwithintwoyearsimmediatelyfollowingtheexpirationofthattimelimitrequestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.

　　Exceptforcircumstancesprescribedinprecedingparagraph,whereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofanyotherjustifiedreason,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateofreceiptofanotificationfromthepatentadministrationdepartmentundertheStateCouncil,requestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.

　　WhereanypartyconcernedrequeststorestorehisoritsrightaccordingtoparagraphoneorparagraphtwoofthisRule,heoritshallsubmitarequestforrestorationofhisoritsright,statingthereasons,attaching,ifnecessary,therelevantcertifyingdocuments,andgothroughtherelevantformalitieswhichshouldhavebeencompliedwithbeforethelossofhisoritsright.WherethepartyconcernedrequestsforrestorationofhisoritsrightaccordingtoparagraphtwoofthisRule,heoritshallpaythefeeforrequestforrestorationofright.

　　WherethepartyconcernedmakesarequestforanextensionofatimelimitspecifiedbythepatentadministrationdepartmentundertheStateCouncil,heoritshall,beforethetimelimitexpires,statethereasonstothepatentadministrationdepartmentundertheStateCouncilandgothroughtherelevantformalities.

　　TheprovisionsofparagraphsoneandtwoofthisRuleshallnotbeapplicabletothetimelimitreferredtoinArticles24,29,42and68ofthePatentLaw.

　　Rule7.Whereanapplicationforapatentrelatestotheinterestsofnationaldefenseandisrequiredtobekeptsecret,theapplicationforpatentshallbefiledwithandexaminedbythepatentdepartmentofnationaldefense.WhereanapplicationforpatentreceivedbythepatentadministrationdepartmentundertheStateCouncilrelatestotheinterestsofnationaldefenseandisrequiredtobekeptsecret,theapplicationshallbepromptlyforwardedtothepatentdepartmentofnationaldefencetocarryouttheexamination.Whereitisfoundafterexaminationbythepatentdepartmentofnationaldefencethereisnocauseforrejectionoftheapplication,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontograntthepatentrightconcerningnationaldefense.

　　WherethepatentadministrationdepartmentundertheStateCouncilfindsthatanapplicationforpatentforinventionorpatentforutilitymodelfiledwithitrelatestonationalsecurityorothervitalinterestsotherthaninterestsconcerningnationaldefenseandisrequiredtobekeptsecret,itshallpromptlymakeadecisiononhandlingitasanapplicationforsecretpatentandnotifytheapplicantaccordingly.ThespecialproceduresfortheexaminationandreexaminationofapplicationforsecretpatentaswellastheinvalidationofsecretpatentshallbeprovidedforbythepatentadministrationdepartmentundertheStateCouncil.

　　Rule8.TheinventionorutilitymodeldevelopedinChinaasmentionedinArticle20ofthePatentLawreferstoaninventionorutilitymodelofwhichthesubstantivecontentsofthetechnicalsolutionweremadewithintheterritoryofChina.

　　WhereanyentityorindividualintendstofileanapplicationforpatentabroadfortheinventionorutilitymodeldevelopedinChina,itorheshallrequest,byoneofthefollowingmanner,thepatentadministrationdepartmentundertheStateCounciltoconductconfidentialityexamination:

（1）whereanyentityorindividualintendstofileanapplicationforpatentdirectlyinaforeigncountryoraninternationalpatentapplicationwitharelevantforeignorganization,itorheshallfilearequestforconfidentialityexaminationinadvancewiththepatentadministrationdepartmentundertheStateCouncilanddescribetherelatedtechnicalsolutionindetail;

（2）whereafterhavingfiledanapplicationforpatentwiththepatentadministrationdepartmentundertheStateCouncil,theapplicantintendstofileanapplicationforpatentinaforeigncountryoraninternationalpatentapplicationwitharelevantforeignorganization,itorheshallfiletherequestforconfidentialityexaminationwiththepatentadministrationdepartmentundertheStateCouncilbeforefilingoftheapplicationforpatentinaforeigncountryortheinternationalpatentapplicationwiththerelevantforeignorganization.

　　WheretheapplicantfilesaninternationalpatentapplicationwiththepatentadministrationdepartmentundertheStateCouncil,itorheshallbedeemedtohavesimultaneouslyfiledtherequestforconfidentialityexamination.

　　Rule9.WherethepatentadministrationdepartmentundertheStateCouncilreceivesarequestfiledunderRule8oftheseImplementingRegulationsandfinds,uponexamination,thattheinventionorutilitymodelmayrelatetothesecurityorvitalinterestoftheStateandisrequiredtobekeptsecret,itshallpromptlyissueanotificationofconfidentialityexaminationtotheapplicant.Iftheapplicantfailstoreceivethenotificationofconfidentialityexaminationwithinfourmonthsfromthedateoffilingitsorhisrequest,itorhemayfile,inrespectoftheinventionorutilitymodel,anapplicationforpatentinaforeigncountryoraninternationalpatentapplicationwiththerelevantforeignorganization.

　　WherethepatentadministrationdepartmentundertheStateCouncilcarriesoutaconfidentialityexaminationinaccordancewiththenotificationprescribedintheprecedingparagraph,itshallpromptlymakeadecisiononwhethertheinventionorutilitymodeisrequiredtobekeptsecretandnotifytheapplicantaccordingly.Iftheapplicantfailstoreceivesuchadecisionwithinsixmonthsfromthedateoffilingitsorhisrequest,itorhemayfile,inrespectoftheinventionorutilitymodel,anapplicationforpatentinaforeigncountryoraninternationalpatentapplicationwiththerelevantforeignorganization.

　　Rule10.Anyinvention-creationthatiscontrarytothelawsreferredtoinArticle5ofthePatentLawshallnot

　　includetheinvention-creationmerelybecausetheexploitationofwhichisprohibitedbythelaws.

　　Rule11.ThedateoffilingreferredtointhePatentLaw,exceptforthosereferredtoinArticles28and42,meanstheprioritydatewherepriorityisclaimed.

　　ThedateoffilingreferredtointheseImplementingRegulations,exceptasotherwiseprescribed,meansthedateoffilingprescribedinArticle28ofthePatentLaw.

　　Rule12."Aserviceinvention-creationmadebyapersoninexecutionofthetasksoftheentitytowhichhebelongs"referredtoinArticle6ofthePatentLawmeansanyinvention-creationmade:

　　（l）inthecourseofperforminghisownduty;

（2）inexecutionofanytask,otherthanhisownduty,whichwasentrustedtohimbytheentitytowhichhebelongs;

　　（3）withinoneyearfromhis
